Abstract

The purpose of this chapter is to explore the causal relationship between racial profiling and miscarriages of justices. After reviewing the wrongful conviction of Thomas McGowan, which was predicated upon racial profiling, this chapter will compare racial profiling with criminal profiling; discuss how racial profiling is racist, unconstitutional, and illegal; explain the resurgence of racial profiling; and examine racism and law enforcement and the efficacy of racial profiling. We will conclude with a discussion of the causal relationship between racial profiling and miscarriages of justice.
