Abstract

China is a socialist state under the people’s democratic dictatorship led by the working class (through the Communist Party of China (CPC)) and based on the alliance of workers and peasants, indicating the fundamental nature of the Chinese state, i.e., China’s nature of state. What then is the form of government? China’s form of government is the people’s congress system based on democratic centralism. In terms of politics and science of law or constitutional democratic theory, as the ruling party of the People’s Republic of China (PRC), the CPC should hold state power in both the nature of state and the form of government. The CPC should directly or indirectly exercise national legislative power, administrative power, judicial power, procuratorial power, and supervisory power in the capacity of national public powers.
