Abstract

The Impeccable Incident is the latest in a long line of Chinese state actions by which the Chinese government is seeking to revise international law to legitimize coastal state authority to place limits on the freedom of navigation and overflight of foreign military vessels and aircraft in the exclusive economic zone (EEZ). In order to assess the current state of international law on this important practice, this chapter reviews regional state practice concerning foreign military activities in the EEZ. Observations about regional trends and practices are offered for the Indian Ocean and East Asian regions since they reflect the state activity in this area of the law. The chapter also reviews state practices concerning foreign military activities in the EEZ by region in order to develop a deeper sense of the motivations that inform trends in state practices.
