Abstract

Before attempting to qualify an expert in court, it is important to determine whether he or she has the necessary qualifications in the first place. This may seem obvious, but if we look at it a little more closely, it makes sense. Before hiring an expert, it is important to determine if he or she has the qualifications necessary to be an expert witness when it comes to the evidence in your case. For example, just because an examiner may be an expert in computer forensics, it does not mean he or she is an expert in cell phones. This chapter looks at the Federal Rules of Evidence Rule 702 regarding the qualification of expert witnesses. Also discussed here are the types and nature of qualifying documents and statements of expert witnesses in digital forensics. Lastly, the questions for the purpose of voir dire regarding the qualifications of expert witnesses are looked upon.
