Abstract

The issue of this work focuses on the critical analysis of the relevance of consumer personal data protection in the information society. The objective is to explain the relevance of the topic in light of the Brazilian General Data Protection Law and the California Consumer Privacy Act in the United States, in a micro-comparative approach. The literature review method was used, based on the theoretical-scientific construction through a comparison of the Brazilian and Californian legislation. To better understand the importance of protecting personal data today, the article discusses the global context of the knowledge society, the changes it has brought about in consumer relations, and then analyzes the Brazilian General Data Protection Law and the California Consumer Privacy Act. After studying both laws, it concludes that, considering the experience of the State of California and the growth of e-commerce in the country, it is up to Brazil to regulate the matter of protecting the consumer's personal data.
