Abstract

Objective: the article defends the constitutionality of the Legal Sanitation Framework, focusing on controversies related to the division of powers between the Union, states and municipalities. Methods: it was a jurisprudential study in which the entire content of the direct actions of unconstitutionality submitted to the Federal Supreme Court, which discuss the constitutionality of Law n. 14.026/2020, as well as other judicial review cases related to the subject. The normative text was obtained on a website, as well as the full content of the judgments of the lawsuits. Results: previous judgments were found that converge with what the legislator determined in the Legal Sanitation Framework. Conclusion: despite the criticism directed at the new Legal Sanitation Framework, its formulation followed the criteria imposed by the Federal Constitution of 1988 and the positions of the Federal Supreme Court in the exercise of its power to interpret the constitutional text.
