Abstract

Current article studies the issue of ariya (borrowing something without any payment), its Sharia rulings and types which are based on socio-legal relations in the sources of the classical period of the Hanafi school. An important feature of researching the issue of ariya in the sources of Islamic law is that along with the regulation of social relations between people, it will be a solution to today’s pressing problems in this area. The scientific article cites verses from the Qur’an and hadiths. Furthermore, the works of well-known Hanafi fakihs in Maverannahr and the Islamic world, who commented on this issue, citations and comparative analysis were made from the work of Abu Ishaq ash-Shirazi (d. 486), one of the faqihs of the Shafi’i madhhab. Purpose. The purpose of the work is to analyze and scientifically substantiate the ariya relations, its place and types in the sources of Islamic law. Methods. Methods such as complex approach, systematization, historical, comparative-critical, source studies were applied while conducting this topic. Results. The article emphasizes that, although ariya relations are based on verses from the Qur’an, hadiths, and the consensus of the ummah (union of scholars), they are optional in terms of necessity. At the same time, the types of arias - “real ariya” and “figurative ariya” were studied, and it was observed that each of them was divided into “absolute ariya” and “mukayyad ariya”. Conclusion. Today, it has become common to look at the issue of ariya as a manifestation of social relations, and its jurisprudential aspects have been forgotten. However, from the point of Islamic law, the study of the arian issue as a separate topic in the jurisprudential sources written in Maverannahr shows how important the arian issues were for society in the opinion of the of the faqihs in society. Today, in the period of globalization and modernization of the Uzbek society, it is extremely important to preserve such traditional values as ariya, the legal basis of which was laid by Islam on the basis of the Koran, hadith and fiqh, which is also an important factor in educating the younger generation.
