Abstract

This article aims to analyze, from a contemporary legal perspective, the stigma and prejudice in relation to HIV positives and homosexuals, in the light of the movie Philadelphia, from 1993. Based on the interdisciplinary analysis of technical data, and the legislation itself, it is possible to observe - will provide a background on the conceptualization of stigma and prejudice, and the main aspects of the stigmatizing discourse of HIV-positive and homosexuals, in order to understand the participation of the Public Power in this process, and understand the strengthening of sexual rights as the eventual key to new realities.
