Abstract

Indonesia is a state of law, where all actions or deeds carried out by each individual or group have been regulated in laws and regulations. The conception of the State of Law or Rechtsstaat is listed in the Explanation of the 1945 Constitution, formulated explicitly in Article 1 paragraph (3) which states that Indonesia is a State of Law. Indonesia is a country that has a diversity of ethnicities and cultures as well as different beliefs but still has one goal, mutual respect and tolerance for every difference that exists. In a group of Betawi people in Bekasi, there is a custom called Uang Pelangkah. Indonesia is a state of law, where all actions or deeds carried out by each individual or group have been regulated in laws and regulations. The conception of NUang pelangkah is money or goods given by the younger brother to his sister to marry first, money pelangkah is a custom that is believed to be hereditary from ancient times to the present. The community believes that pelangkah money is a disaster repellent and as a tribute to an older brother who will be stepped over by his younger brother, the community believes that if a younger brother does not give pelangkah money when going to step over his brother to get married then, a brother will get a mate in a very long time and his family will get a disaster. So the stepping money has become a habit of the Betawi Indigenous people. The purpose of this writing is to find out Betawi customs, namely stepping money in the perspective of Customary Law and Islamic Law and aims to find out how the application of Receptio A Contrario Theory in relation to Stepping Money. This writing is made to facilitate the development of legal and cultural sciences, especially stepping money in Betawi customs in the perspective of Customary Law and Islamic Law. It is hoped that it can be an input for legal practitioners and the community, especially regarding the customs of stepping money. The method that the author makes in this research is normative-empirical, namely combining normative law which is then supported by additional data or empirical elements.
