Abstract

The development of technology turns out to have both positive and negative impacts on society, especially in relation to the use of internet access which is able to connect people with the latest information that can be widely and massively circulated. However, sometimes the use of the internet is actually able to provoke a different situation, for example due to the spread of fake content or news containing related to certain issues, especially politics, religion and culture, which can trigger riots, and sometimes even chaos or clashes occur.In guaranteeing the right to access information and freedom of communication, the Government has issued Law Number 11 of 2008 concerning Electronic Information and Transactions as amended by Law Number 19 of 2016. One of the authorities of the Government is to impose restrictions on internet access, whenever certain circumstances occur that disturb the safety and comfort of the community. In this study, the researcher will focus on several problems, namely how to regulate the authority to restrict internet access according to statutory regulations, what are the effects in overcoming the riots that arise due to the spread of hoax news and finally what regulations are really appropriate to overcome news distribution hoaxes in Indonesia. This research is presented normatively with an analytical knife using the theory of authority and the theory of legal protection.
