Abstract
This paper aims to provide an overview of the case-law trends of international investment tribunals, concerning the provisions governing the dispute resolution mechanisms for conflicts arising between investors and States in the Comprehensive and Progressive Agreement for Trans-Pacific Partnership. In particular, these notes address investment arbitration and are intended to provide notions regarding its preliminary requirements; the period of limitation of claims; waivers as a mechanism to ensure the exclusivity of arbitration; and; the possibility of Host States to file counter-claims.

El CPTPP o, también, TPP-11, por el número de países originalmente signatarios En su segunda parte (sección B), el TPP-11 establece los mecanismos de resolución de controversias para las contiendas surgidas entre inversionistas y Estados (la consulta, los buenos oficios, la mediación, la conciliación, la negociación y el arbitraje). En el presente trabajo se pretende reflexionar, observar y dar cuenta de las tendencias jurisprudenciales de los tribunales internacionales de inversión, en relación con diversas disposiciones que el CPTPP dispone en su sección de resolución de controversias Inversionista-Estado. Cada Estado es un sujeto de derecho internacional soberano, de modo que no es posible emplear la aplicación o interpretación del derecho de inversión realizada en un laudo en otra disputa iniciada en contra de otro Estado. Tal como se verá, la existencia de laudos arbitrales conteniendo diversas y hasta contradictorias decisiones e interpretaciones sobre la misma cuestión debatida por las partes[10]
