Abstract

1. CONTENTS (1) RESEARCH OBJECTIVES The purpose of this study is to examine prior studies and literature on legal superficies, and to derive measures to improve them in each field by dividing them into legislative and practical aspects. (2) RESEARCH METHOD The purpose of this study is to identify issues related to statutory superficies stipulated to relieve disputes arising from different landowners and building owners and to suggest ways to effectively improve them. (3) RESEARCH FINDINGS As a result of analyzing the relative importance of AHP analysis on how to improve legal superficies for real estate experts, it was analyzed that the first priority should be to prepare a plan to improve purchase responsibility. Next, it was analyzed in the order of improving the information disclosure request system and granting practical investigation authority. 2. RESULTS Based on the above analysis results, five ways to improve legal superficies were presented. First, substantial investigative authority should be granted. Second, the interests of landowners must be improved. Third, legislation of statutory superficies under common law should be made as soon as possible. Fourth, the concept of buildings must be clarified. Fifth, the right to claim a collective auction must be recognized.
