Abstract
Opinion of Advocate General Maciej Szpunar in Spiegel Online, Case C-516/17, EU:C:2019:16 (in progress) Advocate General (AG) Maciej Szpunar handed down his much-awaited Opinion in Spiegel Online, C-516/17 on 10 January 2019. The Opinion addresses a set of questions referred by the German Federal Supreme Court (BGH) on one of the most controversial provisions in the EU copyright acquis: Article 5 of Directive 2001/29 (InfoSoc Directive). The questions concern not only the interpretation of specific paragraphs of Article 5 but also the freedom of Member States in implementing copyright exceptions and their relationship with fundamental rights.
