Abstract

Although Brazil has a federal constitution (the Constitution of the Federal Republic of Brazil of 5 October 1988), the Brazilian Code of Civil Procedure governs procedure in courts throughout the whole country. This makes the Brazilian system, covering as it does the whole of the fourth largest country in the world, one of the very largest anywhere. This chapter begins with descriptions of Brazilian courts and civil procedure. It then discusses legal costs, the appeal procedure, main problems encountered in the administration of civil justice, procedural laws, reforms of the procedural laws, and alternative modes of dispute resolution. It concludes with an assessment of the present state of affairs.
