Abstract

AbstractA properly drafted and executed contract identifies and minimizes unexpected risk to produce successful projects. This paper identifies commonly troublesome issues, including some that may prove fatal in contracting, to provide decision makers with case examples illustrating solutions and tools for avoiding, confronting, and overcoming these issues. The authors, an environmental scientist and a legal advisor, address the interrelated issues of environmental protection, readiness, government policy, regulation, and contract law. Collectively, they have served as owner, contractor, and subcontractor for Department of Defense, Department of Energy, consulting engineering companies, and legal firms. They have drawn from these experiences in drafting this paper based on successes and failures of a variety of projects. © 2003 Wiley Periodicals, Inc.
