Abstract
The principle of separation of powers and the fear of entering into political issues or affecting the powers of other Powers of Government, remain as one of the most frequent reasons for the rejection of the writs of mandamus against the Government. In this piece, starting from a real case, the errors of those motives are analyzed and it concludes in the correct solution from the point of view of the Constitutional Law in force.

Acción de amparo sobre el acceso a los servicios de comunicación audiovisual de personas con discapacidad auditiva “Writ of mandamus” on the access to audiovisual communication services for people with a hearing impairment. Resumen: El principio de separación de poderes, y el temor de ingresar en temas políticos o afectar las competencias de otros poderes, siguen siendo algunos de los motivos más frecuentes para el rechazo de acciones de amparo contra el Estado. Partiendo de un caso real, se analizan los errores de dichos motivos y se concluye en cuál es la solución correcta desde el punto de vista del Derecho Constitucional vigente.
