Abstract

The Judicial Police conduct the criminal investigation through informal procedures and also through the bureau instruction of the Police Inquiry doing a sort of pre-procedural “guilt formation”. It is an inquisitional action of criminal public policy wich interferes with intimacy and freedom of people with a degree of selectiviness and discretion that must be demonstrated through a referential of critical criminology. The objective of this research is to see how it builds the agenda of this public safety program and if this police action combat or induces the criminality. Seeking an alternative compatible with the referential used, the study suggests the abolition of the current model concentrated in the Union and in the United and as a hypothesis model it is offered one decentralized county model. To this conclusion, it was analyzed the police culture, legal habitus, the existing discourse among its actors, inherited investigative practices of an etiological paradigm of criminology, the form of accountability that is exerted on the steps of the investigative procedure and the method used for the investigation of crimes.

Introdução

O objetivo deste artigo é analisar o serviço público de investigação criminal realizado pela polícia judiciária para tentar entender as possíveis razões pelas quais essa atuação policial tem-se mostrado tão ineficiente. O segundo item desenvolve ainda mais a tese Kuhniana dos paradigmas aplicado às flexibilidades dos estudos sociais, analisando sinteticamente a evolução paradigmática das escolas de criminologia, sob os enfoques clássicos, etiólogicos, garantistas e críticos, tentando estabelecer um corolário com os conhecimentos do campo e da cultura policial para tentar verificar a existência ou não de uma diferença entre os conceitos buscando explicações para a crise do sistema policial. É feita também uma análise do controle do Inquérito Policial sob as duas formas existentes: o externo exercido pelo Ministério Público e o interno exercido pelas Corregedorias de Polícia, tentando aferir em que medida mecanismos de regulação interna da atividade policial pode ser mais eficiente do que mecanismos externos, ou o contrário, se um mecanismo de controle exclusivamente externo seria mais eficiente. Sugere-se uma revolução copernicana no sistema policial, o que, no nosso caso, poderia ser uma polícia municipalizada
