A análise da constitucionalidade das emendas nº 86/2015 e a nº 95/2016 pelo Supremo Tribunal Federal – Vinculações para o custeio dos direitos sociais e vedação ao retrocesso social

Abstract

The Federal Constitution authorizes the elaboration and modification of Public Finance Law, but establishes limits, such as norms that allocate public funds for the financing of fundamental rights and the principle of the prohibition of social regression. The Constitutional Amendments nº 86/2015 and nº 95/2016 placed these limits under analysis, and this issue was taken to the Federal Supreme Court, as will be presented in this study.
