Abstract
With the unpromising drift of now both legislative and judiciary functions of the WTO, FTA has long been emerging not only as a substitute, but also as a reliable system of international trade. Particularly at this juncture of the elevating international competition, the TBT regulations in the FTAs provide meaningful guide for ideal development of trade regulations focusing on the principle of transparency. In many cases, the FTA TBT chapters have constantly enhanced transparency, by making the principle legally omnipresent throughout the chapter, engaging with specific industries and products, and reifying some formally-vague concepts like reasonable lengths of certain period. The future TBT rules will likely follow these directions, and prevent unnecessary trade conflicts and disputes.
