Introduction

The eminent German jurist Rudolf von Ihering is the founder of the realistic doctrine of law and the state, the essence of which is to find a balance between “broad” legal thinking and normative. По Иерингу, – это, прежде всего, установление баланса между вознаграждением и наказанием. Иеринг посредством различных форм: товариществ, ассоциаций, союзов, кредитования и т.д., стремился раскрыть аппарат, которым пользуется общество для удовлетворения своих потребностей с помощью эгоизма (интереса) под влиянием идеи о цели. Идея справедливости отвечает интересам общества, сообразно с ними достигается равновесие между деянием и последствиями его совершения, отсюда правонарушение влечет за собой наказание, а заслуга – вознаграждение.
