Abstract

Purpose of this article is to highlight the experience of national security and defense administration accumulated by military administration agencies of Georgia, Kazakhstan and India on the basis of a systematic analysis of the bases of the legal regulation of the activities and the generalization of the practice of functioning. Methods used during the process of writing the article were based on dialectical and materialistic approach, which enabled to determine the background for the formation of national models of national security and defense administration of Georgia, Kazakhstan and India. Also, historical and legal method (for highlighting the historical background for development of the system of governmental law enforcement agencies in the states mentioned) was used, structural and functional method (for identifying the features of organizational and functional development of military administration subjects of Georgia, Kazakhstan and India), combining of differentiation and integration (allowed to differentiate the competence of most important institutions in Georgia, Kazakhstan and India, which perform similar tasks in order to ensure state security and to maintain a proper level of defense capability of the state), method of theoretical and legal forecasting (for grounding the perspective tasks of legal science concerning further research of positive foreign experience in organizing the activities of the bodies ensuring national security and defense, in order to introduce it into the national practice of Ukraine). Results of the scientific research of the topic selected have shown that today, the administration of ensuring national security and defense in Georgia, Kazakhstan and India is performed by the extensive system of military administration bodies. Among them, the most significant institution is the armed forces of the state which take the main responsibility in the area of armed protection of state sovereignty, territorial integrity and forceful counteraction against terrorism. Conclusions. The doctrinal development of models of national security and defense capabilities of both Ukraine’s allies of the post-soviet counties and developed states of the South Asia by the national scientists is a factor of the accumulation of systematic information that is to be used in the process of reforming the national system of ensuring state security and defense of Ukraine. In this view, the promising direction of scientific development for the national specialists is the elaboration of proposals on borrowing and implementing the best foreign experience into the national practice of Ukraine’s security and defense sector functioning. Particularly interesting in this regard is the experience of governing relevant structures, organizational and legal support of their activity, the definition of legal grounds of the use of force and special means.
