Abstract

Supply contract is a form of contemporary mode of business through which trade goods are being supplied according to contract between the parties on prior or later payments or payments. This term of contract is also applicable on the provision of services as the details have been discussed in the contents of this research paper. Shariah adaptation and Jurisprudence of supply contract is an important research work in the aspect of the public involvement in daily needs dealings such as supply of milk, water, newspapers and some other needy goods at their doorsteps. This article deals with the prescription of the kind of contract to which supply contract relates. Opinions of contemporary jurists and Islamic scholars have been discussed in detail along with their argumentation in this regard. All of these scholars have consensus on its validity and legality in Islamic perspective. Second main part of this discussion is related to Islamic rulings about this type of contract. Arguments from Qura’nic verses and Sunnah of Holly Prophet ﷺhave been discussed in detail. Some rational and logical points also have been discussed to prove that it is the logical requirement to consider it valid and shariah contract. Ending portion of this research paper consists of results of the research and prescription of some recommendations for further improvement of the research regarding supply contract.
