Abstract

The article is devoted to the development of one of the areas of customs policy of Ukraine in the European integration process. The subject of the study is the customs legislation and practic of the EU and Ukraine on the protection of intellectual property rights, the process of implementation and changes of customs procedures and customs formalities aimed at the protection of intellectual property rights in international trade. The purpose of the study is to analyze the state of adaptacion of EU Regulations into national legislation, implemented on the basis of the experience of customs authorities of EU countries in applying customs procedures and customs formalities aimed at protecting intellectual property rights in international trade. Empirical methods became the methodological basis of the research: research of a specific phenomenon, description, generalization, classification, as well as theoretical methods: analysis and synthesis. Using empirical methods, the European integration process of Ukraine was investigated as a specific objective phenomenon. Generalization and description of information on the development of EU customs legislation, aimed at establishing, supplementing and improving customs procedures and formalities, for the protection of intellectual property rights and their implementation in the customs legislation of Ukraine, has been carried out. The analysis method was used to determine the state of implementation of EU customs legislation to national legislation. Using the classification method, primary (main), secondary (derivative) and mixed customs procedures for the protection of intellectual property rights were selected. With the help of methods of analysis and generalization, the conclusions of the study were formulated and proposals were made for further steps to improve the customs legislation of Ukraine for the protection of intellectual property rights and further work on bringing it to EU standards.
