Abstract

ملخص بحث ( نسيان الأصل وإنکاره تحديث الفرع وأثره في الحکم على الرواية ) شغلت مسألة نسيان أو إنکار الأصل تحديث الفرع المحدثين والأصوليين على السواء ؛ حتى صارت أحد المباحث الأساسية في مؤلفاتهم في مصطلح الحديث وأصول الفقه ، وحاول بعض المحدثين - کالدارقطني ومن بعده الخطيب البغدادي - جمع الروايات المرتبطة بذلک الأمر ، وفي هذا البحث أتناول مسألة النسيان وأقسامه وأثره في الحکم على الراوي والرواية ، کما أتناول مسألة إنکار الأصل تحديث الفرع وأقسامها وأقوال العلماء فيها ، وصولا إلى ترجيح ما أراه الأصوب في المسألة ، مستقصيا لأهم الأسباب الداعية إلى إنکار الأصل تحديث الفرع ، ثم أختم بنماذج تطبيقية حاولت فيها جمع کل ما تيسر لي الوقوف عليه من روايات في ذلک .
