Abstract

The article highlights the criterias and features, that are specific to the voluntary abandonment and an active repentance. There are discussed the viewes from the scientific literature about these two institues. The aim of the paper was to find out the main issues that seperates the voluntary abandonment from the active repentance and identify current problems, so the research according to the comparative-legal, logical and analytical methods analyses the objective and subjective aspects of voluntary crime and statistical data. The paper discusseses the specifics and main issues that characterize the voluntary abandonment on the ongoing crime. The article based on the research decides and presents the appropriate, right and legal ways to release a human from criminal liability in such cases.
