مدى مشروعیة العملات الافتراضیة وأثرها فی عقود التبرعات فی الفقه الإسلامی

Abstract

ظهر ما يعرف بالعملات الافتراضية أو النقود الرقمية الإلکترونية، وتعد العملة الافتراضية البيتکوين من أکثر النقود الافتراضية انتشارا وقبولا، بين مستخدمي تلک النقود، وهي نوع جديد من أنـواع العمـلات النقديـة. وتعد العمــــلات الرقميــــة اليــــوم مرحلــــة جديــــدة وخطيــــرة مــــن مراحــــل تطــــور النقــــود حيث إنه قد تطــــورت أشــــکالها وصــــورها عبــــر العصور المختلفة، خصوصا في ظل الانتشار المتزايد لهذه العملات، والذي شکل مصدرا للقلق والتساؤل حول حقيقة هذه العمــلات وأثرهـــا علـــى اقتصـــاديات الـــدول والأفـــراد، کمـــا زاد الانقســـام الـــدائر حولهـــا بـــين مؤيـــد ومعـــارض الإشکال الدائر حولها مما جعـــل دراســـة هـــذا الموضوع من المسائل الملحة. وفي هذا البحث أحاول بيان حقيقة العملات الافتراضية والفرق بينها وبين النقود الورقية، ومن ثم بيان الحکم الشرعي في استخدامها في عقود التبرعات في الفقه الإسلامي. ويســــعى البحـــــث إلى الکشف عـــــن حقيقـة العمـــــلات الافتراضـية، وکيفيـــــة إصدارها وبيان حکمها الفقهـــــي، وبيان حکم إصدار النقود دون إذن الحاکم أو من ينيبه، وبيان حکم إجراء عقود التبرعات باستخدام العملات الافتراضية. ويهدف-أيضا- إلى محاولة جمع الأقوال الفقهية المتعلقة بحکم هذا الموضوع المهم والجديد. ويهدف إلى محاولة معرفة طبيعة العلاقة بين النقود التي ذکرها الفقهاء المتقدمين والعملات الافتراضية. ويهدف إلى محاولة إيجاد إجابات عن تساؤلات الدراسة. Abstract : What is known as virtual currencies or electronic digital money has emerged, and the virtual currency Bitcoin is one of the most widespread and acceptable virtual money among users of that money, which is a new type of currency. Digital currency is today a new phase and dangerous stages of the evolution of money as it has evolved forms and manifestations across different ages, especially in light of the increasing prevalence of these currencies, which is a source of concern and wonder about the fact that these currencies and its impact on the economies of the countries and individuals, also increased the division revolving around between Supporters and opponents of the problem surrounding it, which made the study of this issue an urgent issue. In this research, I try to explain the reality of virtual currencies and the difference between them and paper money, and then explain the Islamic ruling on their use in donation contracts in Islamic jurisprudence. The research seeks to explain the truth about virtual currencies, how they were issued, and a statement of their jurisprudential ruling, a statement of the ruling on issuing money without the permission of the ruler or his representative, and a statement of the ruling on making donation contracts using virtual currencies. It also aims to collect the jurisprudential sayings related to the rule of this important and new topic. It aims to try to know the nature of the relationship between the money mentioned by advanced jurists and virtual currencies, and it aims to try to find answers to the study's questions.
