Abstract

The article provides a brief analysis of the problem of determining the legal regime for subsoil use waste. During the study of this problem, contradictions and fragmentation of legal regulations were identified, giving rise to competition between legislation on subsoil and production and consumption waste in terms of consolidating the legal regime of subsoil waste. Based on the analysis of doctrinal sources, judicial practice and relevant rules of law, in order to determine the legal regime of objects arising during the implementation of mining activities, the need was identified for the mandatory conduct by the subsoil user of a comprehensive geological and economic assessment of these objects. As a result of the study, recommendations were proposed for making changes and additions to the norms of current legislation regulating the analyzed social relations, allowing to solve the identified problem.
