Abstract

The article deals with topical issues related to the understanding and characterization of the institutional principles of probation, taking into account the provisions of Federal Law No. 10-FZ of February 6, 2023 “About probation in the Russian Federation.” The principles of probation as the main guiding ideas are the vector guidelines for ensuring the practical activities of the probation institute. Disclosure of the essence of the entire system of principles and each principle separately will allow for the competent implementation of a set of probation measures, which will effectively affect the unity of law enforcement practice in relation to persons who find themselves in a difficult life situation in connection with the commission of a crime. According to the author, the state's appeal to the implementation of the probation institute is a confirmation of ensuring the current social policy and social functions. The use of a combination of general scientific and private scientific methods in the research process allowed us to formulate the conclusion that only with constant, systematic and uniform guidance of the principles of probation can positive dynamics of all probation measures and effective indicators of probation effectiveness be achieved. At the same time, this article reflects the author's subjective position on this issue.
