Abstract

The article analyzes the International Labor Organization Convention No. 184 «On the Safety and Hygiene of Work in Agriculture» as one of the primary sources of international legal regulation of relations on labor protection in agriculture. It determines the degree of incorporation of its provisions in national legislation. It is revealed that Convention No. 184 is complex in nature and covers all aspects of the regulation on labor protection in agriculture – from national policies in the field of occupational safety and health, establishing safety requirements for the operation of equipment, implementation of technological activities in animal husbandry and crop production, reflecting the characteristics of work of minors and women, and regulating working time issues, occupational accident and occupational disease insurance, reflection of the peculiarities of employment of children and women and to regulation of the problems of organization of working time, insurance against accidents at work and occupational diseases. This international act lays down the sectoral foundations of labor protection in agriculture of our country, and the fulfillment of Ukraine's obligations under it – a condition of ensuring the constitutional right of persons engaged in agricultural production to proper, safe and healthy working conditions. The study found that domestic agricultural labor law, in general, meets the requirements of Convention No. 184, which has contributed significantly to the renewal of the regulatory framework in recent years. As for the provisions of Convention No. 184, which have not yet been implemented in Ukrainian law, they must be performed based on the rule of law and taking into account the conformity of ratified international agreements with the legislation of Ukraine.
