مشابهة الإجماع للسنة فی المنظور الأصولی

Abstract

يعنى البحث بإبراز وجوه مشابهة الإجماع للسنة النبوية، ومشارکته لها، وقد وقفت على فکرة البحث أثناء قراءتى ودراستى لبابى السنة والإجماع، فلقد وجدت العديد من وجوه المشابهة بل والمطابقة بين الدليلين، ولم أظفر بدراسة سابقة عنيت بإظهار هذا الجانب، ورأيت أن وضع دراسة تجمع هذه الوجوه وتحقق تلک المشابهة تکون إن شاء الله- کاشفة عن بعض وجوه الحکمة فى نصب الإجماع دليلا شرعيا، وبيان أن الإجماع صنو السنة، وأنهما خرجا من مشکاة واحدة، وأنه لا يسع منصفا يقبل السنة دليلا شرعيا أن يرد الإجماع، وأن المتجرئين على الطعن فى حجية الإجماع ما خرجوا فى تلک الدعوى إلا عن قصور نظر أو فساد طوية، وإلا فالإجماع کما يقول إمام الحرمين: عصام الشريعة وعمادها وإليه استنادها. وکما يقول البزدوى: من أنکر الإجماع فقد أبطل دينه کله، لأن مدار أصول الدين کلها ومرجعها إلى إجماع المسلمين. اهـ. فکانت هذه الدراسة حاملة فى طياتها لواء الدفاع عن حجية الإجماع الذى هو مصدر من أهم مصادر الشريعة الإسلامية The research means highlighting aspects similar to the consensus of the Prophet’s Sunnah, and his participation in it. I stood on the idea of ​​the research during my reading and study of the two sources of al-Sunnah and consensus. I found many similar aspects and even the matching between the two evidence, and I did not win a previous study that meant showing this aspect, and I saw that a study that combines these The faces and the realization of that similarity will be, God willing - revealing some aspects of wisdom in establishing consensus as legal evidence, and stating that consensus is the Sunnah, and that they came out of a single niche, and that a fair person who accepts the Sunnah as legal evidence cannot respond The consensus, and that those who have ventured to challenge the authenticity of consensus did not depart in that case except for lack of consideration or a folded corruption. Otherwise, unanimity, as the Imam of the Two Holy Sanctuaries says: The essence of the Shariah , its pillar , and to whom it is based. And as Al-Bazdawi says: Whoever denies consensus has annulled his entire religion, because the focus of all the principles of the religion and its reference is to the consensus of Muslims. Ah. The aim of this study is the defending the authority of the consensus, which is one of the most important sources of Islamic law.
