Abstract

The article deals with certain issues of the procedure for collecting a court penalty. The procedure for awarding a court penalty in various types of court proceedings is investigated. A comparative analysis of the norms of arbitration and civil procedural law regulating the procedure for collecting a court penalty is carried out. The practice of collecting a court penalty in arbitration courts and courts of general jurisdiction is considered. Attention is focused on the problems of legal regulation, gaps in legislation and inconsistency of application practice.
