Abstract
انبنى هذا البحث من مقدمة ومبحثين، وتم الاعتماد على المنهج الوصفي مع الاستعانة بالمنهجين الاستنباطي والاستقرائي، وهدف بشكل أساسي إلى شرح قاعدة جناية العجماء جبار وإبراز تطبيقاتها القديمة والمعاصرة: حيث بين أهمية هذه القاعدة الفقهية ودورها في حل كثير من المسائل المعاصرة والتي تتعلق بالجناية الواقعة على النفس أو ما دونها أو على الممتلكات. وانطباق كثير من الصور المعاصرة لوسائل النقل والمعدات، المستخدمة في أماكن العمل من قبل المقاولين والقطع الحربية والعسكرية والمصانع والآلات على قاعدة جناية العجماء جبار. وانضباط ذلك بعدم التعدي والتقصير، وعليه فيلحق حكم جناية السيارة والطائرة والقطار والمعدات الثقيلة من غير تعد ولا تقصير بجناية الدابة: فتكون على الهدر سواء كانت على النفس أو ما دونها أو الممتلكات، ويقترح الباحث تضمين قاعدة جناية العجماء جبار في أحكام السير وقوانين المرور لتكون هي الفصل في حال التحاكم للقانون.

Abstract: This research was built from an introduction and two chapters, and it was relied on the descriptive approach with the use of the deductive and inductive approaches, and it mainly aimed at explaining the rule of no compensation in the crime of animals and highlighting its ancient and contemporary applications: where the study showed the importance of this jurisprudential rule and its role in solving many contemporary issues related to Felonies committed against oneself or others, or property
The study showed the applicability of many contemporary images of means of transportation and equipment, used in workplaces by contractors, war and military parts, factories and machinery, on the basis of no compensation in animal felony
The study clarified the discipline of not trespassing or negligence, and the verdict of the car, plane, train and heavy equipment felony is attached without transgression or negligence in the animal felony ruling
