تکييف عقد الامتياز التجاري في الفقه والنظام صالح بن عبد الله بن صالح السعوي قسم: الشريعة، کلية الآداب. الجامعة: جامعة الملک عبد العزيز. المدينة: جدة، الدولة: السعودية. البريد الإلکتروني: jsalsaawi@gmail.com ملخص البحث: انتشر مؤخرا العمل بأسلوب الامتياز التجاري في العالم العربي وفي المملکة العربية السعودية خصوصا، ثم صدر نظام الامتياز التجاري حديثا، ويمثل العمل بالامتياز أهمية بالغة وأثر کبير على الاقتصاد، تطلب ذلک بحث طبيعة هذا العقد، فاجتهد الباحث ببيان المقصود بالامتياز التجاري، وطبيعته القانونية وما يحيط بها من إشکال، وبيان أنواعه المختلفة، وتکييفه قانون ، وإيضاح العناصر الجوهرية التي ما يقوم عليه العقد، ثم تکييفه فقها، وبيان العقود المشابهة له، وتحرير مسألة الأصل في العقود، ثم بيان الحکم الشرعي للدخول في هذا العقد. Adapting the Commercial Concession Contract in Jurisprudence and Discipline By: Saleh Bin Abdallah Al- Saudi Department of Sharia Faculty of Arts King Abdul- Aziz University Jeddah- Saudi Arabia Abstract Recently, the system of commercial concession has flooded the Arab World in general and Saudi Arabia in Particular. Consequently, the system of commercial concession has been identified for its great importance and its large influence on economy. Hence, it has become necessary to examine the nature of this contract and the researcher diligently tries to clarify the objective of commercial concession, its legal nature, the surrounding issues, its various types, its lawful adaption, highlighting the major elements of this contract then its jurisprudential adaption; referring to similar contracts, specifying the issue of the originals of those contracts and pointing out the legitimate provision of entering into this type of contracts.
