Abstract

The article discusses the problematic issues associated with the formation of the High Anti-Corruption Court in Ukraine. Particular attention is paid to the category of "virtue" for candidates for judges, the obligation to publish anonymized information on the results of voting at a special joint meeting of the High Qualification Commission of Judges of Ukraine and the Public Council of International Experts, the need to establish the boundaries of this council in the process of implementing a special procedure for the qualification assessment of candidates for judges.According to the results of the research proposals to improve the procedures for the selection of judges by amending the laws of Ukraine "On the Judicial System and Status of Judges" and "On the High Anti-Corruption Court" were substantiated. In particular, in order to ensure the implementation of the principle of transparency in the procedure for selecting judges in the High Anti-Corruption Court, it is proposed:1) determine in the Law of Ukraine "On the Judicial System and the Status of Judges" the criteria of the category "virtue" for candidates for the position of judge, taking into account the fact that the criterion "virtue" applies to all candidates for the position of judge of courts of general jurisdiction;2) establish in the Law of Ukraine "On the High Anti-Corruption Court" the obligation of the High Qualification Commission of Judges of Ukraine to officially disclose anonymized information on the results of voting at a special joint meeting of the High Qualification Commission of Judges of Ukraine and the Public Council of International Experts in compliance with the requirements of confidentiality of personal voting.It is noted that compliance with the principles of objectivity, transparency and thoroughness during the special joint meeting of the High Qualifications Commission of Judges of Ukraine and the Public Council of International Experts will help ensure the absence of reasonable doubts about the integrity and practical skills of the candidate for the post of judge of the High Anti-Corruption Court.
