Abstract

يهدف هذا البحث إلى بيان أهمية موضوع أحکام المفقود في الفقه الإسلامي مقارنة بتطبيقات هذه الأحکام في قانون الأحوال الشخصية الأردني والکويتي، وذلک من خلال بيان مفهوم المفقود في اللغة واصطلاح الفقهاء، وبيان اختلاف الفقهاء في الأثار المترتبة على فقد المسلم بما يتعلق بزوجته وماله، وقد تطرق البحث إلى کيفية ثبوت الفقد فقها وقانونا والخطوات القانونية في ذلک. الکلمات المفتاحية: المفقود - الفقه الإسلامي - قوانين الأحوال الشخصية The Laws concerning Al-Mafqūd (the Missing Person): Islamic Jurisprudence versus Jordanian and Kuwaiti Personal Status Laws By: Dr. Bassam Muhammad Qasim Omar Assistant Professor at the Department of the Principles of Religion, the Faculty of Sharia, Al-Zarqa University, Jordan E.MAIL: bassam.qasim22@hotmail.com Abstract This paper seeks to elucidate the significance of the topic, the laws concerning al-mafqūd, with respect to their application in the Islamic jurisprudence, compared to Jordanian and Kuwaiti Personal Status Laws. It, therefore, illustrates the definitions of al-mafqūd lexically and contextually by jurists. It also highlights the impact of scholars’ disagreement on a missing person, with regards to their money and spouse. The paper touches upon how the state of being missing is proven according to both fiqh and civil law, following certain legal steps. Key words: al-mafqūd – Islamic fiqh - Personal Status Laws
