Abstract

The concept of “crime” is one of the fundamental concepts of criminal law. The analysis of the internal content of this concept makes it possible to understand the social essence of the crime, and the analysis of the content of its signs makes it possible to distinguish a criminal act from a non-criminal act. In this article, attention will be paid to such a feature of the crime as punishability. The content of this feature is of interest, first of all, based on the lack of an unambiguous opinion on its attribution to the signs of a crime. The article analyzes various points of view on the issue under study and makes the author’s conclusion about the attribution of punishability to the signs of a crime.
