국경 간 데이터 이동에 관한 국제적 논의 동향과 대응 방안 (Cross-Border Data Flows: Discussions and Countermeasures)

Korean Abstract: 최근 국제사회에서 국경 간 데이터 이동(cross-border data flows)에 관한 논의가 활발하다. APEC, OECD, UNCTAD, World Bank 등 국제기구에서는 국경 간 데이터 이동과 관련된 주제로 협력방안을 모색하고, TTIP, RCEP, TiSA 등 협정은 데이터의 국경 간 자유로운 이동과 데이터 지역화 조치 금지를 협상 안건으로 다루며, CPTPP, USMCA를 포함한 자유무역협정에서는 국경 간 데이터의 자유로운 이동 촉진과 데이터 지역화 조치 금지를 의무로 규정한다. 데이터 통상환경이 변화하는 가운데 미국, 유럽, 중국 등 주요국은 자국 내 데이터 규제와 법제를 정비하고 있다. 이 보고서는 국경 간 데이터 이동에 관한 국제적 논의 동향을 체계적으로 파악하고 주요국 데이터 규제를 한국과 비교분석하며, 데이터 규제 변화에 따른 글로벌 후생효과에 대한 정량적 분석 결과에 기초하여 한국이 당면한 현안을 식별하고 대응방안을 모색하였다. English Abstract: This report reviews discussions about cross-border data flows in international organizations and recent free trade agreements and conducts comparative analysis of data protection regulations among the United States, European Union, China and Korea. It also examines the relationship between cross-border data flows and domestic data protection regulations and quantifies the welfare impact of the EU GDPR and data localization on the global economy.
