Abstract
In this article the author attempts to review the procedural status of the defender through the prism of its structural units — the rights, duties and responsibilities. The conclusion is made, that it is necessary to take into account the moment of the beginning of exercise of the criminal procedural function of the defender in determination of the defender’s status. Also the status of the defender acting by the lawyer is analyzed.
