Abstract

The article highlights problematic issues of applying the principle of direct action of the Constitution of the Russian Federation when courts of general jurisdiction consider criminal cases of abuse of power. The subject of the study includes the principle of direct action of the Basic Law, provides doctrinal sources in which the topic raised in the article was discussed, the legal positions of the Constitutional Court of the Russian Federation, and provides examples from judicial practice. Scientific provisions aimed at developing comprehensive measures to eliminate shortcomings in law enforcement practice in cases of this category are proposed for discussion.
