Policies addressing suspension and expulsion in state early care and education subsystems: A national census of policy alignment and integration

Exclusion from early care and education (ECE) programs creates employment challenges for families and disrupts learning for children, often differentially impacting children placed at-risk due to income, race, and disability. Federal policy guidance and changes in the Child Care and Development Fund (CCDF) Block Grant requirements are meant to influence states to create policies that will both regulate and prevent disciplinary exclusions, especially suspension and expulsion. We present a national census of states’ CCDF plans, center-based child care licensing regulations, and state pre-K policies addressing suspension and expulsion. Using content analysis methodology, we evaluate the presence of key policy components of suspension and expulsion prevention including data collection, parent/family involvement in the process of exclusions, accessing community resources, and the use of developmental information to inform the use of exclusionary discipline. Our results indicate that expulsion and suspension policies vary widely both across states, and within the same state's subsystems. The component found most frequently across all subsystems is an expulsion policy, with noticeable variation in specifying and defining suspension. Our findings also point to a great deal of variance in policy alignment, with pre-K including the most information on expulsion and suspension policies and prevention. As state-level policymakers seek to adopt policies that reduce exclusion in ECE, our findings point to a need to consider the importance of creating policies that protect children, especially those over exposed to exclusionary discipline, and then aligning those components within and across ECE subsystems to promote equitable access to ECE. This is particularly important for low-income families, Black children, children with disabilities, and boys.

A pilot study of a micro-course to promote positive teaching practices and prevent exclusionary discipline in early childhood

The past two decades of research have underscored the concerning use of exclusionary discipline in early childhood education settings and the need for professional development to support educators to use evidence-based practices. Existing professional development, such as coaching and infant/early childhood mental health consultation, are effective but pose implementation challenges due to time and resource demands. The need for scalable, cost-effective professional development that focuses on social and emotional development and challenging behavior is higher than ever. Short, online, self-paced courses (what we refer to as “micro-courses”) are one approach to addressing these challenges. In this paper, we examine initial evidence for how a micro-course can support in-service early childhood educators to learn and use evidence-based universal strategies to support positive behavior, which may indirectly reduce exclusionary discipline. We leverage quantitative and qualitative data from 25 educators who piloted the course in spring 2022 to report on early childhood educators’ engagement and satisfaction with the micro-course and whether educators report any changes in their knowledge or practices. We found that early childhood educators actively participated in the micro-course, found the experience useful and relevant, and reported changes in their knowledge of and comfort with positive behavior support practices as a result of participation. This study can inform future policy, practice, and research efforts to equitably support children's positive behavior, prevent challenging behavior, and eliminate exclusion in early childhood settings.

Addressing violence against educators: What do teachers say works?

School personnel safety and well-being have received increased attention via national outlets; however, research is limited. The current investigation is the first to examine the reported use and perceived effectiveness of commonly used school-based intervention approaches for addressing school violence, specifically violence against teachers in U.S. schools. A sample of 4,471 prekindergarten-12th grade teachers was asked to rate the use and perceived effectiveness of common school-based approaches, namely exclusionary discipline (e.g., suspensions), school hardening (e.g., metal detectors, school police), prevention (e.g., school climate improvement, social-emotional learning, classroom management), and crisis intervention practices (e.g., de-escalation, physical restraint) to address verbal/threatening, physical, and property violence against teachers. Findings revealed that teachers rated prevention practices as most effective in reducing violence against teachers. The use of exclusionary discipline and crisis intervention practices at school was positively associated with all three forms of violence. Ratings of the effectiveness of specific practices were associated with lower likelihoods of verbal/threatening (i.e., hardening, prevention), physical (i.e., exclusionary discipline, hardening, prevention), and property (i.e., hardening) violence. Up the down escalator? Examining a decade of school discipline reforms

Racial inequality in exclusionary discipline is one of the salient educational equity challenges facing educational stakeholders in the United States (U.S.). This study synthesizes recent empirical evidence (2010–2022) on the effectiveness of school discipline reforms in the U.S. Although the overall use of exclusionary discipline has declined in the past decade, a growing number of studies indicate that the benefits of policy and programmatic changes are not greater for African American students. Thus, racial disparities in office discipline referrals (ODRs) and suspensions remain, with a few notable exceptions. Several recommendations emerge for educational policymakers and leaders contemplating school discipline reforms that lower ODRs for African American students including: a) rejecting race-neutral school discipline reforms and strategically coordinating various alternative approaches to exclusionary discipline such as policy changes and programmatic investments, b) prohibiting suspensions for attendance-related infractions, c) investing in the fidelity of the implementation of school-based programs such as Restorative Justice and Positive Behavioral Interventions and Supports and complementing these programs with school mental health, and d) investing in developing an empathic mindset, coaching, and professional development in classroom management and culturally responsive practices for educators.

Exclusionary Discipline in Early Childhood

The purpose of this exploratory qualitative study was to examine how the perceptions and experiences of teachers relate to the suspension and expulsion of preschoolers in Catholic schools.Results indicated that teachers have a range of experiences with suspension, from children being removed from the classroom temporarily to out-of-school suspensions lasting up to a week. Most participants also had experienced expelling a student because of behavior. Patterns that emerged from the data included a frequency of extreme behavior from some children, the application of various strategies in response to challenging behavior, the use of exclusionary discipline when other strategies did not work, and a resistance to change practices without additional supports. Implications for research and practice are discussed.

Evaluation of the whole school restorative practices project: One-year impact on discipline incidents

The current study addressed the need for experimental research on Restorative Practices (RP) in its evaluation of the Morningside Center for Teaching Social Responsibility's Whole School RP Project. The study was conducted in a large Northeastern city using a cluster randomized controlled design in 18 elementary, middle, and high schools. In a single year, before the COVID-19 pandemic, and with data from 5878 students, the study found that overall, students in the RP Project schools were less likely to receive a discipline incident record (11.1%) as compared to students in the comparison schools (18.2%). However, differential treatment effects based on sex, race/ethnicity, and disability status were not found. The findings suggest prevention efforts are a cornerstone of practice/policy reforms to reduce the use of exclusionary discipline. Findings also suggest multi-year initiatives are needed to address discipline disparities.

Addressing Race and Implicit Bias in the Functional Behavior Assessment Process: A Pilot Study of Preservice Teacher Training Modules

ABSTRACT Despite decades of research and reform, exclusionary discipline remains disproportionately used with minoritized students and students with disabilities (SWD). The present study investigates how functional behavior assessment (FBA) and Positive Behavior Support Plan (PBSP) procedures can be taught in conjunction with an explicit focus on achieving equitable outcomes for minoritized SWD. Specifically, researchers created modules for preservice teachers focused on racial and cultural bias within the FBA and PBSP processes. In this manuscript, we will detail the development, delivery, and preservice teachers’ perceptions of modules, directly and explicitly challenge color-evasive FBA and PBSP practices, and consider how PBSPs can be culturally responsive. We present results of social validity surveys and the School Record Analysis (SRA), a tool used to measure preservice teachers’ implicit racial biases. Exploratory results suggest the modules provide a promising and necessary step for using behavior analysis to address disproportionate use of exclusionary discipline for minoritized SWD.

Reining in Punitive Discipline: Recent Trends in Exclusionary School Discipline Disparities

Concerns around disparities in suspensions and expulsions from schools in the United States have resulted in a concerted effort to reduce the use of exclusionary school discipline. In this article, the authors describe trends in the use of exclusionary discipline in Indiana and Oregon, two U.S. states with different school discipline policy climates. The findings point to a substantial decline in the use of suspensions and other forms of exclusionary discipline in both states. The authors further find that racial and socioeconomic disparities have recently narrowed in both states, though Black students and students who were identified as economically disadvantaged remain likely to be disproportionately exposed to exclusionary discipline. These trends, and their timing, illustrate the broad-based change in disciplinary norms that has occurred in the U.S. over the past decade.

Exclusionary discipline in U.S. public schools: A comparative examination of use in Pre-Kindergarten and K-12 grades

ABSTRACT The use of exclusionary discipline (ExD) was compared for U.S. public pre-kindergarten (Pre-K) and K-12 grades within the same school. ExD rates were 10 times higher in K-12 than in Pre-K when calculated for all schools but ExD rates were comparable for schools that reported at least one case of ExD in Pre-K. Additionally, disparities in the use of ExD were observed for both Pre-K and K-12 schools: higher rates were found for boys relative to girls, for Black children relative to White children, and for charter schools relative to non-charter schools. While most schools did not use ExD, when they did, they did so at high rates. The use of ExD appears to be associated with school-level factors including a culture of use.

Keeping Black Girls in School: A Systematic Review of Opportunities to Address Exclusionary Discipline Disparity

A punitive legacy of the responses to school shootings in the United States is the expansion of exclusionary discipline. Black girls have disproportionately experienced this form of punishment as compared to white girls and non-Black girls of color. A small, but growing, body of research has examined the patterns and causes of this disparity. Current studies have made suggestions for possible solutions to address this disparity, but these recommendations are not readily accessible in a single location. A catalogue of these ideas could provide a useful foundation for policy development and evaluation. The present research note seeks to generate this resource by conducting a systematic review to identify and categorize recommendations aimed at reducing the discipline disparity experienced by Black girls. Based on this review, four categories emerged that center around: (1) culturally competent school programs, (2) enhanced teacher training, (3) spaces at school for empowering Black girls, and (4) trauma-informed student policies. This research note discusses these categories of recommendations using an intersectional framework and concludes with a summary of next steps to guide future research and policy work to address the disproportionate use of exclusionary discipline against Black girls.

Developing a Framework for Curtailing Exclusionary Discipline for African-American Students with Disruptive Behavior Problems: A Mixed-Methods Approach

Using a mixed-methods approach in a predominantly African-American school district, a set of qualitative studies were conducted to establish priority areas for school-based interventions to curtail the use of exclusionary practices with African-American students exhibiting disruptive behavior. Study 1 employed concept-mapping methodology with a focus group of 11 key stakeholders—teachers, school counselors and administrators—and generated five potential target areas, as well as ratings of their perceived importance and feasibility. These target areas included: social-emotional supports, parental involvement, academic support/pedagogy, policies and staff, and community linkages. Study 2 involved phone interviews with 10 parents of students placed in an alternative school setting in the same school district, and a retrospective review of their children’s school records. Triangulated data were used to develop a conceptual framework to understand the use of exclusionary discipline with troubled students and to guide intervention development in this community.

Disciplinary disparities by race and disability: using DisCrit theory to examine the manifestation determination review process in special education in the United States

ABSTRACT Exclusionary discipline practices in the United States are used disproportionately in the punishment of Black students with a disability compared to White and Black students with or without a disability. One potential mechanism leading to the disproportionate use of exclusionary discipline is a process called ‘manifestation determination reviews’ (MDR), a process mandated under the U.S. federal Individuals with Disabilities Act that is tasked with determining whether students’ offending behaviours were related to their disability. Using a disability studies/critical race theory (DisCrit) lens, the MDR process can be understood as a mechanism that serves to sustain these inequities through vague guidance in critical elements of the MDR process, lack of clarity about the composition of the MDR team, and perpetuation of a race-neutral framework. Implications for policy, educators, and school psychologists within the United States are discussed.

Examining racial/ethnic disparities in school discipline in the context of student-reported behavior infractions

Although traditional methodologies of measuring racial/ethnic disparities in the use of exclusionary discipline have provided overwhelming evidence that students of color are far more likely than White students to experience exclusionary punishment, studies using these methods have been criticized for not accounting for students' general patterns of behavior, and also for not examining the extent to which students disproportionately receive non-exclusionary consequences (e.g., warnings). The current study examined both exclusionary and non-exclusionary forms of discipline for disproportionality, using a traditional percentage method as well as binary logistic regression to estimate the impact of students' self-reported number, frequency, and engagement in particular behavior infractions on the odds that students would also report one or more suspensions, office referrals, personal warnings from a teacher, or warnings about their behavior sent home. Engagement in particular behaviors had differential impact for African American vs. White students on the odds of receiving behavioral warnings, with African American students being less likely to be warned than their White peers. The current study demonstrates both the presence of disproportionality in non-exclusionary discipline as well as evidence that African American students experience escalated consequences (e.g., lower likelihood of receiving a warning) for infractions when they also engage in certain behaviors, even if those behaviors are not the direct cause for discipline. By maintaining differential consequences for behavior infractions committed by African American students vs. White students, schools can mirror racialized differences in policing and the criminal justice system, and through their role as agents of socialization, normalize such unequal systems for youth.

Discipline Reform: The Impact of a Statewide Ban on Suspensions for Truancy

Chronic absenteeism and truancy have been linked to a variety of undesirable outcomes for students including increased risk of dropout, lower test scores, lower educational and social engagement, juvenile delinquency, and substance abuse. One controversial response to truancy is the use of exclusionary discipline, such as out-of-school suspensions (OSS). Out of concern that such a practice is counter-intuitive and likely not effective at improving student engagement or academic outcomes, some states have recently banned this practice altogether. This analysis uses Arkansas as a case study to estimate the impact of a state-level ban on the use of OSS for truancy on attendance—an important measure related to student engagement and opportunity to learn. Using an eight-year panel of student-level data in a difference-in-differences framework, we find no evidence of improvement in attendance for truant students. Implications for policy design, implementation, and evaluation are discussed.

Questioning the impacts of legislative change on the use of exclusionary discipline in the context of broader system reforms: a Queensland case-study

ABSTRACT This study analyses exclusion, enrolment cancellation, and suspension rates in government schools in the Australian state of Queensland to investigate the impact of legislation to extend principals’ disciplinary powers. Results suggest that the provision of alternative disciplinary options, including Saturday detentions and community service, failed to curb increases in the use of enrolment cancellations and exclusions as originally intended. Moreover, suspension rates increased at more than double the rate of enrolment growth during the same period. Year on year analysis of suspension rates reveals two specific calendar years and two particular grade levels in which there were very large increases. These calendar years coincide with two key education reforms in Queensland in addition to the extension of principals’ power, indicating that the move to extend principals’ disciplinary powers interacted with other major education reforms occurring within that same period. Grade level patterns indicate that education policy and school environments may play a role in rising school suspension rates.

Reviewing the Progress of School Discipline Reform

ABSTRACTIn the 1990s and early 2000s, schools across the United States employed exclusionary discipline at increasing rates as a response to student infractions. Researchers studying school discipline reported on these increases and highlighted the fact that exclusionary discipline for students was associated with myriad other negative outcomes, including lower academic achievement, grade retention and drop-out, and even involvement with the juvenile justice system. Moreover, a related strand of research emerged, providing evidence that these consequences were not being levied evenly to different types of students. That is, marginalized students were far more likely to be faced with disciplinary consequences at school. For these and other reasons, policymakers and school leaders implemented some high-profile reforms to discipline policies in school districts across the country in an attempt to limit the use of exclusionary discipline. In this article, I introduce several of these reforms and briefly describe the early impacts of these changes to school discipline policy in locations such as Los Angeles, New York City, Chicago, Philadelphia, and the state of Arkansas. I conclude by summarizing what lessons we can derive from these studies and describe the implications for future work in this area.

Examining Disparities in Student Discipline: Mapping Inequities from Infractions to Consequences

ABSTRACTMounting evidence indicates that students of color are more likely than their white peers to receive exclusionary discipline (out-of-school suspensions and expulsions), but alleviating these disparities requires an understanding of what drives them. In this study, we use seven years of student- and infraction-level data from every public school in Arkansas to examine disproportionalities within and across districts and schools. Prior analyses of the same data found that black students are more likely to receive exclusionary discipline than their white peers, even after controlling for the nature and number of disciplinary referrals, but most of the differences occur between schools, rather than within. We build on these findings in two ways: (a) by estimating the racial disparities in the likelihood of referral for particular infraction types and (b) by estimating whether the racial disproportionalities in the use of exclusionary discipline, after controlling for reported behavior, differ according to the types of infractions reported. We find that for common, subjective infractions, black students are at a higher risk of referral and at a higher risk of exclusionary discipline, conditional on referral. In addition, disparities appear to be driven by differences across school districts (rather than within). These findings have important implications for designing and targeting discipline reforms where they are needed most.

Labeling and the Differential Impact of School Discipline on Negative Life Outcomes: Assessing Ethno-Racial Variation in the School-to-Prison Pipeline

The relationship between educational attainment and involvement in the criminal justice system is one of the most consistent findings in the criminological literature. Contributing to this relationship is the increased and disproportionate use of exclusionary discipline, particularly among ethno-racial minorities. Exclusionary discipline is correlated with negative life outcomes however; scholars have yet to examine the impact of school discipline on behavioral outcomes across race and ethnicity. Using data from the National Longitudinal Study of Adolescent and Adult Health, this study addresses this gap by modeling the pathways from school exclusion to future dropout, delinquency, and criminal offending for White, Black, and Hispanic youth. Results suggest significant differences in the effect of school exclusion on future outcomes across ethno-racial groups.

Disparate use of exclusionary discipline: Evidence on inequities in school discipline from a U.S. state

There is much discussion in the United States about exclusionary discipline (suspensions and expulsions) in schools. According to a 2014 report from the U.S. Department of Education’s Office for Civil Rights, Black students represent 15% of students, but 44% of students suspended more than once and 36% of expelled students. This analysis uses seven years of individual infraction-level data from public schools in Arkansas. We find that marginalized students are more likely to receive exclusionary discipline, even after controlling for the nature and number of disciplinary referrals, but that most of the differences occur across rather than within schools. Across the state, black students are about 2.4 times as likely to receive exclusionary discipline (conditional on reported infractions and other student characteristics) whereas within school, this same conditional disparity is not statistically significant. Within schools, the disproportionalities in exclusionary discipline are driven primarily by non-race factors such as free- and reduced-price lunch (FRL) eligibility and special education status. We find, not surprisingly, that schools with larger proportions of non-White students tend to give out longer punishments, regardless of school income levels, measured by FRL rates. Combined, these results appear to indicate multiple tiers of disadvantage: race drives most of the disparities across schools, whereas within schools, FRL or special education status may matter more.
