SUSPENSION OF CONTRACT AND ITS IMPACT ON CONTRACT OBLIGATIONS

This purpose of this research is to examine the impact of suspending the execution of a contract on obligations in bilateral contracts. Suspension is a legal means based on judicial and practical applications and insurance custom. The importance of this research is clear given the changing economic conditions of the world today, and their consequences based on traditional solutions of termination and annulment of contracts. These are at odds with the contract suspension system that helps to overcome any difficulties or obstacles out of the control of the contracting parties that prevent its execution and to continue its existence with the aim of preserving the contractual bond and preventing it from disappearing for a certain period of time. Once the difficulties have ended the contract shall come back into force with the same terms and conditions that were agreed upon in advance. Due to the failure of Jordanian law to address this topic, we have tried through this research to show what the system of suspending the execution of a contract is and its impact on the obligations of contractors during the suspension period and after the resumption of the execution of the contract.

Impactos psicossociais e econômicos em atletas e treinadores olímpicos/paraolímpicos de modalidades aquáticas devido ao COVID-19: percepções, discursos e perspectivas

Este artigo busca apresentar a perspectiva de 15 protagonistas do movimento olímpico e paraolímpico brasileiro sobre a forma como estão enfrentando o “Isolamento Social” devido ao COVID-19, como o adiamento de todas as competições esportivas no ano de 2020, sendo a mais importante delas os Jogos Olímpicos e Paraolímpicos de Tóquio 2020. O objetivo deste trabalho foi investigar o ponto de vista dos 15 atletas e treinadores olímpicos e paraolímpicos das modalidades aquáticas que treinavam em São Paulo sobre diversos fatores do isolamento social, como treinamento, ansiedade, perspectivas. Está é uma pesquisa qualitativa, com coleta de dados virtuais e entrevistas semiestruturadas. Discussões: Adiamento dos Jogos; Bolsa Atleta; Treinamento. Considerações: Importância do Bolsa Atleta neste momento de pandemia por conta da redução de salário e suspensão de contratos com patrocinadores; Diferença de Discurso entre o sujeito coletivo atleta e treinador sobre os impactos do COVID no treinamento; Posicionamento Político contra ações do governo federal, principalmente o Presidente da República Jair Bolsonaro.

The Effects of Non-Performance of Contract as a Result of Frustration of Purpose

Appearing of forcible events or other reasons which hinder the performance of contract or cause its frustration has special legal effects and destroy the casual link between the obligator and the loss resulting from its non-performance. In this situation, these reasons affect the structure of contract and possibly may cause the discharge or suspension of contract. Therefore, the effect of occurring this kind of excuse are twofold. One of the important consequences of occurring this event is the exemption of the obligator from contractual responsibility, because, the non-performance is not attributed to him. The other effect is that force majeure changes the structure of the contract. A contract that encounters to force majeure may be discharged forcibly or willingly or its performance suspended. Our purpose in this article is to review these effects.
