САМОАКТУАЛИЗАЦИЯ ОСУЖДЕННОГО КАК ОДИН ИЗ ПСИХОЛОГИЧЕСКИХ КРИТЕРИЕВ ЕГО ИСПРАВЛЕНИЯ

The article considers the possibility of using self-actualization indicators as markers of the convict's formation on the path of correction. It contains the results of an empirical study of the features of self-actualization of men aged 25-29, divided into three groups: previously convicted persons who were again in a pre-trial detention center in the status of suspects and accused; first brought to criminal responsibility, detained in a pre-trial detention center; men with the problem of finding a new job. It was found that the indicators of self-actualization were significantly higher in the group of men who found themselves in a pre-trial detention center for the first time, and they are specific for each of the three groups. It is concluded that the indicators of self-actualization can act as markers of correction of the convicted person (to indicate either his becoming on the path of correction, or the deepening of criminalization). The directions of further research on the problem of self-actualization of suspects, accused, convicted are shown.

Police Treatment of the Public in Police Stations: Evidence from Zaria, Nigeria

Abstract The police occupy a very important position in the entire criminal justice system in Nigeria. The nature of police relationship with the people and the manner in which the public were handled at the station and on the street daily within the community affects the way the people perceive them and the level of cooperation they get from the people in curbing crime in the society. The study took place in Zaria, Kaduna state, Northern Nigeria. A study population was the police in Zaria. Three police stations (Zaria City, Sabon Gari, and Samaru police stations) were purposively selected reflecting the socio-cultural and demographic backgrounds of Zaria residence and population. The Divisional Police officers and police officers in-charge of crime were interviewed. The police crime and incidence records were examined while the general conduct and social atmosphere of the police and police stations were observed. Using in-depth interview, observational method, and police records, it was discovered that the socio-economic status of suspects affected how they were treated by the police in the police stations studied. Also, the environment suspect lives affected how they were treated too by the police. It was recommended that the police make the rule of law their guide in the handling of suspects in the police stations irrespective of socio-demographic variable or area of habitation of the suspects. Police brutality and violations of citizen’s rights should be checked by senior police officers, while community-policing style should be implemented across communities in Nigeria.

PENGAMBILAN KEPUTUSAN SECARA KOLEKTIF OLEH PIMPINAN KPK BERDASARKAN PASAL 21 AYAT (5) UNDANG-UNDANG NOMOR 30 TAHUN 2002 TENTANG KOMISI PEMBERANTASAN KORUPSI

Article 21 paragraph (5) of the Corruption Eradication Commission Law states that the Chairperson of the Corruption Eradication Commission works collectively, which in the explanation stated that each decision making must be approved and decided together. The main problem of this research is about the pre-trial case of Budi Gunawan which was determined the suspect the KPK in the arguments of the petitioner's petition stating that the suspect's determination was not carried out collectively because at that time there was a vacancy of one of the KPK Leaders. Therefore this study aims to examine and examine the decision-making process the KPK Leaders as the application of Article 21 paragraph (5) of the KPK Law and also determine the scope of tasks that are collectively decided and agreed upon together. This study uses a normative juridical method. The research specifications used are descriptive analytical, using a statute-approach approach, conceptual approach and comparative approach. The results of the study can be summarized as follows: First, the collective decision-making process is carried out in the form of ordinary mechanisms, formal mechanisms and urgent mechanisms. With the decision making procedure carried out deliberation to reach consensus and use the most votes (voting) as stated in Commission Regulation No. 3 of 2009 concerning the procedures for decision making the KPK leadership, but in the provisions of Article 7 PK / 3/2009 formulate that decision making can be carried out in less than 3 (three) people (not fulfilling the quorum) in the event of an urgent situation, and meaning the collective by the KPK is not always interpreted as making decisions in its entirety (the five leaders), then the provision overrides the actual collective meaning based on the principle of working collectively. Second, as for the scope of the collective decision-making tasks the KPK Leaders regulated in Article 3 CHAPTER III LEADERSHIP Regulation No. 1 of 2015 concerning the Organization and Work Procedure of the KPK, it is stated that the increase in the status of suspects is the scope of tasks decided and agreed collectively with expose procedure. IMPLIKASI PENETAPAN STATUS TERSANGKA BAGI BUPATI TERPILIH TERHADAP PEMILIHAN UMUM KEPALA DAERAH DALAM SISTEM KETATANEGARAAN REPUBLIK INDONESIA

Under the provisions of Article 31 paragraph (1) of Law Number 32 Year 2004 on Regional Government states that, in the head region and/or deputy regional head suspended by the President without going through Parliament because the proposal was convicted of corruption, terrorism, treason, and/or a crime against state security. The article 31 paragraph (2) of Law Number 32 Year 2004 on Regional Head if found guilty by the court decision, the Regents may be dismissed. However, the anti-corruption gives another reason that, Regent who has been declared a suspect is not good to hold office, so it is polemical. This study aimed to analyze the determination of the status of the suspect for the Regent elected as a condition. In addition it also aimed to analyze the implications of determining the status of a suspect for the Regent elected in the general election of regional heads in the constitutional system of the Republic of Indonesia, with reaserch method of yuridis normatif. Determination of the status of the suspect for the regents elected is not a limiting factor for someone to be sworn in as regent. There are two factors that hinder a person inducted into the Regional Head, which is being accused of corruption, terrorism, treason, and/or a crime against state security or convicted of treason and/or other actions that may divide the Republic of Indonesia declared by a court decision that has obtained permanent legal force. Diagnosing Sporadic Creutzfeldt-Jakob Disease in a Patient with a Suspected Status Epilepticus in the Intensive Care Unit

Objective. Several tests are available in the diagnostics of sporadic Creutzfeldt-Jakob disease (sCJD); however, none of these is conclusive. We review the values of these tests, from an intensive care unit (ICU) perspective. Methods. Case report and review of the literature. Results. A 53-year-old woman initially presenting with psychiatric symptoms developed myoclonus and was admitted 1 month later to the ICU with a suspected nonconvulsive status epilepticus and respiratory insufficiency, probably due to extensive antiepileptic drug therapy. Typical MRI and EEG findings and a positive 14-3-3 protein led to the diagnosis of sCJD. All treatments were terminated, and autopsy confirmed sCJD. Conclusions. Clinical signs combined with MRI, EEG, and 14-3-3 and/or tau protein determination might be sufficient to diagnose or exclude sCJD and may therefore prevent the application of unnecessary diagnostic tests.

Guilty until Proved Innocent? The Diminished Status of Suspects at the Point of Remand and as Unconvicted Prisoners

One of the basic principles of English criminal law is that a person suspected of committing a crime is presumed innocent until proved guilty in a court of law. Nowadays, this notion is also enshrined in international law. Arguments about further restrictions to the right of bail following a moral panic concerning so-called ‘bail bandits' have usually overlooked the fact that the detention of people charged with crimes following the refusal of bail is arguably in breach of this presumption, especially where the refusal was based on the likelihood of (further) offending while on bail. Even if such detention is considered permissible, it might reasonably be expected that special provision would be made for the incarceration of the unconvicted. However, once imprisoned, the suspect is increasingly treated as a convicted offender, and in many respects suffers even worse conditions. In the face of official rhetoric which claims that the solution lies either in the hands of the courts (in granting bail more frequently) or in the availability of greater resources (for example, to establish more bail hostels or build more prisons), this paper argues that the same view of ‘no smoke without fire’ which underlies the increasing legal restrictions placed on the right to bail also explains the indifference to the lot of the unconvicted prisoner.

The Clinical Use of Neuromuscular Blocking Agents as an Interpretive Aid to the EEG in Suspected Status Epilepticus

ABSTRACT.Generalized convulsive status epilepticus can evolve into a condition of coma with subtle clinical signs. These subtle signs are often indistinguishable from those of a different etiology. The EEG must be used to assess the ongoing electrical activity of the brain and how that is related to the observed clinical features. Determination of status epilepticus must be done as swiftly as possible since abnormal cerebral potentials can permanently damage the cortex. Movement and electromyogenic artifacts from the patient can obscure interpretation of the recording. Temporary pharmaceutical paralysis with non-depolarizing neuromuscular blocking agents can effectively help distinguish artifact from cerebral potentials and guide patient care. Examples are given of cases in which pharmaceutical paralysis helped in the evaluation of the state of the brain in patients with suspected status epilepticus.
