Efektivitas Pelatihan Kepemimpinan Administrator (PKA) oleh BPSDM Provinsi Jawa Barat Tahun 2023

The State Administration Institute of the Republic of Indonesia (LAN) has issued Decree of the Head of the State Administration Agency Number 2 of 2023 concerning Guidelines for Implementing Structural Leadership Training Activities which is the basis for holding education and leadership training activities for administrator officials. This research will discuss the 2023 Class IV Administrator Leadership Training (PKA) activities which were held in order to meet managerial competency standards in structural civil servant positions. The method used in this research is a qualitative method to analyze the effectiveness of implementing structural leadership training activities which is based on measuring sources, processes and targets. Data collection techniques in this research were carried out through interviews, observation, literature study and documentation. The results of this research show that the implementation of managerial leadership training for the position of Administrator (PKA) Class IV in 2023 carried out by the West Java Province Human Resources Development Agency is hampered by the limited number of class observers, the ability of participants who have not yet adapted to the learning methods applied, as well as disrupting participants' concentration because they had to carry out work tasks in their work unit in between training activities, so that aspects of the process did not run optimally.

State-level regulation of disinfection byproducts in the United States

ABSTRACT Disinfection byproducts (DBPs), residual compounds formed from the chemical disinfection of drinking water, can cause a host of damaging public health and environmental impacts. This study evaluates the landscape of regulations designed to reduce the occurrence and/or impact of DBPs, focusing on regulations issued by the US states. Drawing on a systematic search of state administrative codes and agency websites, we first identify the presence, absence, and layering of DBP-related regulations. We then evaluate the number and types of policy tools – the specific approaches required by each regulation, such as monitoring requirements, economic incentives, and required treatment technologies – to identify how DBPs are being managed and how states cluster with relatively more and less robust regulatory frameworks. Finally, we evaluate the relationship between the regulatory approach and the frequency of drinking water quality violations for DBP compounds. While most states have at least one DBP-specific regulation, these vary substantially in their comprehensiveness. The most-used policy tools (monitoring, compliance schedules, and reporting) directly reflect federal regulations; few states have adopted innovative tools such as collaboration or financial incentives. We observe no relationship between regulatory efforts and water quality violations, suggesting that current policy implementation may not adequately address the complex risk of DBPs.

Identifying Deficiencies in Children's Residential Care in Finland: Inspectors' Views on Working With Information

ABSTRACTAbusive and illegal practices in residential care are a recognised issue in child welfare internationally; thus, the question of how these institutions are supervised is important. However, children's residential care is complex by nature, making its supervision a challenging task. This article examines residential care supervision by looking at the ‘knowledge work’ that two central legality supervisors in Finland—the Parliamentary Ombudsman and Regional State Administrative Agencies—conduct when inspecting children's residential homes. Here, ‘knowledge work’ refers to the process of working with information to identify deficiencies in care. Eleven interviews and 16 inspection reports are analysed with a focus on the nature of the information that these supervisors gather when inspecting residential units and how they evaluate the significance and reliability of the information. The results show that to complete their institutional task, the inspectors gather information from various sources, including documents and interviews with children. The significance of the information is then assessed by comparing it with legislation and the supervisory mandate, and its reliability is verified by considering the diverse information sources as a whole collection of information. The results suggest that how well ‘knowledge work’ is conducted highly affects the impact of supervision.

 The Industrial Relations Court (PHI) is a sub-system of special courts placed within the general judicial sphere. The impact of personality traits on the ethical leadership, job performance and job satisfaction of public servants – A case study of the Northern public sector of Vietnam

The study aims to explore the impact of personality traits on ethical leadership, job performance and job satisfaction of public servants working in the Northern public sector of Vietnam. A quantitative approach was employed to evaluate the impact of personality traits on ethical leadership, job performance, and job satisfaction. A structured questionnaire was administered to obtain information from public servants. The SPSS 26 was used to conduct the demographic information of public servants and the SmartPLS 3.0 version was used to process the SEM. The research results showed Big Five personality traits have a positive impact on ethical leadership, job performance, and job satisfaction. Additionally, ethical leadership and job performance have a positive correlation with the job satisfaction of public servants. The research results were used to recommend leaders of State Administrative agencies in the Red River Delta to understand the personality traits of public servants to increase job satisfaction and achieve greater job performance.

EVALUATION OF CITIZENS' SATISFACTION WITH THE QUALITY OF PUBLIC ADMINISTRATIVE SERVICES IN THE MEKONG DELTA, VIETNAM

Citizen satisfaction is one of the essential factors reflecting the quality of public administrative services provided by state administrative agencies. The study aims to assess citizens' satisfaction with the quality of public administrative services in the Mekong Delta, Vietnam. Research data were collected from survey results using questionnaires from 792 survey samples in the Mekong Delta, Vietnam. Research results have shown that citizens are satisfied with the quality of public administrative services in the Mekong Delta, Vietnam. At the same time, there are six factors affecting citizens' satisfaction with the quality of public administrative services, including (1) Reliability; (2) Service capacity of staff; (3) Service attitude of staff; (4) The service level of staff; (5) Infrastructure; (6) Administrative procedures. Research results show no difference in citizen satisfaction in gender, age and education groups. Besides, the survey area group has a difference in citizen satisfaction. The research results have theoretical and practical significance for public administration in Vietnam. From the research results, several contents are discussed and proposed to improve citizens' satisfaction with the quality of public administrative services in the Mekong Delta, Vietnam.

Role of the State Administrative Court in Realizing Good Governance

Indonesia is a state of Law based on Pancasila and the 1945 Constitution aimed at realizing a prosperous, safe, peaceful and peaceful life for the State and nation and ensuring the equal position of citizens in Law, providing the maintenance of harmonious, balanced, and cooperative relations between State bodies or officials and citizens, in an effort by the Government to organize people's lives to achieve the State's goal of protecting the entire Indonesian nation. All to promote the general welfare, educate the nation's life and all Indonesian bloodshed, promote the general welfare, educate the nation's energy, and participate in implementing world order based on independence, lasting peace, and social justice. The administration of Government should create a condition that leads to the goal that citizens can feel and enjoy the atmosphere and climate of order and legal certainty that is just. In its implementation, there are often conflicts of interest, disputes, and disputes between the State Administration Agency or Officer and citizens that harm or hinder the performance of the Government. The argument is resolved through the State Administrative Court, which must be able to uphold justice, truth, order, and legal certainty so as to provide protection to the community, especially in the relationship between the State Administrative Agency or Officer and the community because the position of the Government is stronger than the people, legal protection of the people must be carried out by a free and independent judicial process. The State Administrative Court resolves the dispute by Law Number 9 of 2004. The State Administrative Court is one of the independent free state judiciary bodies without the influence of other powers, adhering to Pancasila and the 1945 Constitution of the Republic of Indonesia and applicable laws and regulations to juridically control government actions that violate administrative provisions.

This research analyzes the concept of job positions for civil servants in state administrative agencies. And based on the current situation of job positions for civil servants, the author suggests some solutions to improve the institutional framework for determining job positions for civil servants in Vietnam today.

Implications of the Limits for Filing a Lawsuit to the State Administrative Court: Upholding Legal Certainty or Injuring Human Rights?

The State Administrative Court (PTUN), which has the jurisdiction to study, decide, and settle issues in the area of State Administration, is one of the executors of judicial power for those seeking justice for state administrative conflicts. If a state administrative disagreement arises, a State Administrative Decision (KTUN), which is specific, unique, and final in character and has legal ramifications for the person or civil legal organization, will be issued by a state administrative agency or authority. The receiver who feels wronged may file a lawsuit with the Administrative Court within the grace period of 90 (ninety) days as specified in Article 55 of the Law if the KTUN is believed by the recipient to be against the laws and regulations as well as the principles of good governance (UU PTUN). The 90 (ninety) day deadline for filing a lawsuit with the Administrative Court, however, sparked controversy among the general population. This is demonstrated by the fact that the constitutionality of the requirements set forth in Article 55 of the Administrative Court Law governing the deadline for bringing a lawsuit with the Administrative Court has been challenged four times (four) before the Constitutional Court. It would harm human rights rather than serve its intended purpose of ensuring legal certainty and preserving political stability. Through this straightforward essay, the author hopes to clarify and advance comprehension of the State Administrative Court's lawsuit filing deadline, normative legal research techniques, library law research, and data collection techniques.

Strategi Kehumasan Dalam Pelayanan Informasi Publik Di Pusat Pelatihan Dan Pengembangan Dan Kajian Manajemen Pemerintahan Lembaga Administrasi Negara

The study aimed to discover the public relations strategy in public information services at the Center for Training and Development and Government Management Studies at the State Administration Agency (Puslatbang KMP LAN). Data were obtained through data collection techniques using observation, interviews, and documentation studies which were carried out with data analysis techniques consisting of data reduction, data presentation, and conclusions. The results showed that aspects of 1) problem definition, namely the information media managed by public relations was not yet fully known by stakeholders, so that information was not conveyed thoroughly; 2) planning and programming, namely public relations coordinating with teaching facilitators to socialise the social media and connecting every social media; 3) action and communication, namely public relations conducting two-way communication to stakeholders, public relations using electronic and non-electronic media in inserting social media so that stakeholders know the information funnel and public relations utilising several of social media in disseminating information; 4) evaluation, namely that all social media had been known to stakeholders and could be accessed so that comprehensive and up-to-date information was achieved.

Discussions on strengthening the performance of child support began in 2004. This is because the number of single parents who raised minors increased according to the rapid increase of divorce rate at that time. Initially, the Civil Act was amended to make an agreement on child support expenses as an essential procedure in a divorce by agreement, so that an agreement on the burden of child support was reached between divorced couples. However, given that it was not enough to prepare for compulsion of performance, the court can draw up a report on the burden of child support so that it could be enforced immediately. However, considering that it is difficult for single parents to carry out compulsory execution proceedings on their own, an institution was established that could force the implementation of child support. This is a legislative result about the institution of child support performance that was finally made after a decade of discussion in the Ministry of Gender Equality and Family since 2005. However, by placing the Child Support Agency under the Korean Institute for Healthy Family, it has not been able to secure its status as an independent institution. Therefore, as it became difficult for the Child Support Agency to conduct its own duties and proceed with the lawsuit, it caused a problem of delaying the compulsory performance of chil support. In foreign countries, all child support performance institutions are state agencies or administrative agencies, independent institutions, and have the authority to identify the address or property of the child support debtor. However, our Child Support Agency only secures its status as a public institution. In addition, since the work of the Korean Institute for Healthy Family and Child Support Agency are different, it is difficult to organically combine them to perform the work of compulsory child support. Furthermore, in order to accomplish a result regarding instead payment of child support, which is under discussion recently, the Child Support Agency must have appropriate authority to handle the work. The independence and authority of the Child Support Agency should be strengthened as soon as possible.

Regulation on the Authority to Address the Determination of Village Head Election Results as the Object of State Administrative Disputes Has Not Been Based on Justice Value

As for the definition according to Law Number 5 of 1986 article 4, the State Administrative Court is one of the executors of judicial power for the people seeking justice for State Administrative disputes. Apart from the State Administrative Court, other courts as executors of judicial power in Indonesia based on Law Number 48 of 2009 concerning Judicial Power, are the General Court, the Religious Court and the Military Court which culminate in the Supreme Court, as well as an independent Constitutional Court. The type of research used in this research is analytical descriptive. Descriptive research is a form of research aimed at describing existing phenomena, both natural phenomena and man-made phenomena. Judges in being accountable for decisions often also seek support from jurisprudence and science. Seeking support in jurisprudence does not mean that a judge is bound by or has to follow decisions regarding similar cases that have been handed down by the Supreme Court and the Court of Appeal, or that have been decided by him alone. Based on the results of the research and discussion that have been described in the previous chapters, the authors draw conclusions, suggestions, from the results of the research as follows: Weaknesses in the regulatory authority adjudicating the Determination of Village Head Election Results as the Object of the Current State Administrative Dispute, Weaknesses Regulations in Article 1 number 8 and number 9 regarding the understanding of State Administrative Agencies or Officials and State Administrative Decisions in the perspective of current Human Rights, namely that there are weaknesses in the legal structure, legal substance and legal culture.

Authority, Subject and Object of the Dispute At the State Administrative Court (PTUN)

The State Administrative Court is established to anticipate the abuse of authority by the ruler and face conflicts of interest, disputes or disputes that may occur at any time between the community and state administrative agencies or officials. Therefore, this research is conducted to describe the authority, subject and object of dispute in the State Administrative Court using a library research or literature approach. Meanwhile, the approach method used is the normative juridical approach method or doctrinal legal research, which is a legal research whose data source comes from secondary data in the form of laws and regulations, books, and journals related to the focus of the problem. After discussing the existing problems, it can be concluded that the competence of the State Administrative Court includes absolute competence, namely the authority to adjudicate based on the object, material or subject matter of the dispute and the relative competence, namely the authority to adjudicate based on the region or jurisdiction. The object of disputes in the TUN Court is the TUN Decision except for TUN disputes within the TNI and other TUN disputes which according to the TUN Judicial Law are not the authority of the TUN Court where the exceptions are divided into 3 kinds of restrictions. i.e. direct, indirect and direct restrictions are temporary. Meanwhile, the ubjek of disputes in the TUN Court is a person or civil legal entity and a body or official of TUN.

Factors affecting work motivation of Commune Officials in Can Duoc District, Long An province

“Factors affecting work motivation of Commune Officials in Can Duoc District, Long An Province” is a research topic conducted at commune-level state administrative agencies in Can Duoc district. Long An province with the aim to determine the factors affecting the work motivation of commune-level cadres; from there, propose managerial implications to help increase work motivation for commune-level cadres in Can Duoc district, Long An province, thereby building a contingent of qualified grassroots cadres. and capacity to meet the requirements of tasks in the new situation, wholeheartedly and devotedly serving the People, contributing to the construction of a true Party and government agency “of the people, by the people and for the people”. The study conducted a survey and directly consulted with 191 commune-level officials working in Can Duoc district, Long An province. Then, carry out the steps of testing, evaluation, and quantitative analysis using SPSS 20.0 software (descriptive and test statistics, exploratory factor analysis - EFA, regression analysis). The results of the study identified 5 factors that directly affect the work motivation of commune officials in Can Duoc district, Long An province, the level of impact from strong to weak according to the coefficient βeta, respectively: “Training and promotion”, “Leadership”, “Relationship with colleagues”, “Working environment and conditions” and “Wages and benefits”.

Factors influencing the intention to use and recommend e-government services among citizens: A case study in District 5, Ho Chi Minh City

Nowadays, the use of online public services helps reduce travel time and costs for organizations and individuals insubmitting documents and receiving results; increase the publicity and transparency of administrative procedures; improve the responsibility, professional qualifications, and knowledge of information technology of the contingent of civil servants of state administrative agencies assigned to handle administrative procedures; thus, contributing to promoting socio-economic development. The main objective of this study is to explore the factors that influence the intention of citizens to use the electronic public administration services in District 5, Ho Chi Minh City. The research was conducted through a direct survey of 378 residents living in District 5. Data were processed and analyzed using SPSS and AMOS softwares. The results show that attitude, service quality, and trust in the government directly affect people's intention to use e-government administrative services. In addition, the intention to recommend others to use e-government administrative services is directly influenced by service quality, trust in the government and intention to use. This research provides valuable insights to government organizations regarding the citizens' intention to use electronic public administration services.

Measuring the Post-Training Effectiveness of New Training Programs: A Study on DIKLAT PIM Reformer Model

Studies have shown indications of performance improvement due to a training program. In the public sector, this program is highly expected to impact how the officers can demonstrate their capacity to perform their duties well. This program includes a new leadership education and training program called DIKTLAT PIM Model Reformer. This study was aimed at contextually examining the effectiveness of this new model of a training program. This study demonstrated how the basic rule (Regulation of the Head of State Administration Agency Number 13 of 2013 concerning Guidelines for Organizing Level IV Leadership Education and Training) on post-training evaluation was conducted. This current study’s novelty lies in its use of the grounded theory method as an evaluation approach for post-training effectiveness. This current study used the Grounded Theory Method (GTM) and focused on alumni training at the Municipality of Tidore Islands, North Maluku, Indonesia. The results indicated several aspects identified and defined by the alumni concerning the new training program model. The aspects include effectiveness and efficiency improvement, competency measures, leader morality and professionalism, teamwork, source financing, and performance evaluation. This current study enabled its basic regulation on measuring the effectiveness of the training program—DIKTLAT PIM Model Reformer. Future studies are also proposed to overcome this study’s weakness.

Technological advances have brought about rapid changes and frontier lifestyle changes in this globalization era. The ratification of the Electronic Information and Transaction Law and the Personal Data Protection Act are new guidelines in the midst of technological advances to support evidence in the procedural law of the State Administrative Court. The existence of State Administrative disputes has implications for the work of State Administrative courts to measure differences of opinion issued by State Administrative bodies or officials with the community when the public interest arises and decisions from the State Administrative agency or officials are deemed detrimental to the interests of the community. In the settlement of state administrative and criminal cases/cases, the judge must examine the evidence submitted by the parties before making a decision or seeking factual and formal truth. Proof is the most important part of the experiment. The purpose of this study is to determine the arrangement of the electronic evidentiary system and its legal force in the State Administrative Court. The research method used in this study is a normative juridical method, namely a legal research method that is carried out by examining library materials or mere secondary materials. The conclusion of this study is the legal force of electronic evidence in the procedural law of the State Administrative Court.

Proof is the most important part of the experiment. The purpose of this study is to determine the arrangement of the electronic evidentiary system and its legal force in the State Administrative Court. The research method used in this study is a normative juridical method, namely a legal research method that is carried out by examining library materials or mere secondary materials. The conclusion of this study is the legal force of electronic evidence in the procedural law of the State Administrative Court.
