“I Dreamed of an Alliance between the Authority of Dogma and Political Liberty”: Mormonism and Socialism in France in the Nineteenth Century

LEGAL SOCIALISM IN THE HISTORY OF FRENCH POLITICAL AND LEGAL THOUGHT OF THE 19TH–20TH CENTURIES

The article investigates the characteristic features of legal socialism as one of the popular directions of French political and legal thought during the period of existence of the French Third Republic (1870–1940). For the fi rst time in the Russian science the similarities and differences of French legal socialism with the related political and ideological systems (Marxism, solidarism) and also with some foreign legal doctrines (legal socialism of Anton Menger von Wolfensgrün, Ferdinand Lassalle) are highlighted. The article focuses on the political and legal views of Emmanuel Levy, a prominent French jurist and socialist, who, according to many contemporaries, was the founder of legal socialism in France. On the basis of the analysis of literary sources of the epoch as well as modern publications, the author of the article evaluates Emmanuel Lévy’s contribution to the substantiation of socialism in legal categories (legal description of the logic of socialism). To achieve this goal, the author of the article considers Lévy’s ideas about the relative nature of law, about class antagonism as a factor of social life, about the absorption of individual law by collective law, about the triumph of collective law as the fi nal chord of the historical epoch of industrialisation, about the understanding of law as a social function and about the expansion of the boundaries of legal responsibility. Lévy’s ideas about the parameters of a peaceful and non-violent social revolution, the realization of which was linked to the growing infl uence of socialistically thinking judges in the French judicial hierarchy, were also studied. Responding to the social markings of the epoch and the demands of public opinion, these judges were to promote the establishment of a socialist legal order in the state by means of free interpretation of bourgeois laws (in the interests of poor classes).

The 1970s and the Thatcherite Revolution: Crisis of Ideology or Control?

There is a familiar analysis of the 1970s in Britain, of a country locked in decline, paralysed by recurring confrontations due to the ideological fault-lines between capital and labour, and reliant on a political system undermined by an unspoken consensus shared by the ruling elite that the most that could await a post-war and post-imperial Britain was a ‘soft landing’. In this analysis, the failures of the post-war right and left in Britain provide a platform for a political outsider, Margaret Thatcher, to over-turn the political apple-cart and usher in a new ideological revolution founded on reinvigorated concepts of economic agency and individual choice. This article will argue that the Thatcherite revolution was not so much a crisis for the traditional ideologies of left and right, as an indication of the way politics had moved beyond ideology. Drawing parallels with the apparent rebirth of socialism in France that ran concurrently with the Thatcherite revolution, this article will suggest that the success of Thatcher owes much to the divorce between image and reality and the symbolic power this allows leaders to deploy subsequently. Ultimately, we will argue, Thatcher was willing to steer the transformation of British society in ways that ran contrary to the principles of those assumed to be her intellectual mentors, in order to satisfy her desire for control.

May 10, 1981, not only ushered in a political surprise for France, as well as for its European and American allies, but sent positive shockwaves throughout that part of the Caribbean which is still French. On that date François Mitterrand came to power in the Metropole of France at the same time that the Départements d'Outre-Mer (DOM or overseas departments) of Martinique, Guadeloupe and Guiana rejected his candidacy with a unanimity as stunning as it is rare in West Indian politics. Ever since the DOM have been coping with Socialism in France, decentralization in the Caribbean, and an unprecedented antilleanization of local culture, institutions, and politics. The result has been a paradox of heightened social liberalism combined with intensified political violence; but paradox has always been at the heart of the French Antilles.

Socialism in the French Countryside: A Reply

Professor Sandstrom picks out from my articles on this subject the two themes of central importance: the continuity or otherwise between radicalism and socialism in France, and the question of the identity which nineteenth-century socialism presented in its appeals to the peasant. He also makes the telling point that techniques of electoral geography, however subtle, cannot ultimately do more than describe any process of change or continuity: they do not help very much in accounting for it. Consequently he is quite right to criticize my emphasis on voting patterns as a basis on which to establish distinctions between the parties of the left. I would defend myself, however, against the suggestion that my central argument is thereby much weakened, and I think I would still affirm that it was for a very specifically collectivist socialism that the peasantry of the Var voted from the I89os. To begin with, establishing that there is a high chance that the same people voted first Radical and later Socialist (which is a suggestion which must emerge strongly from the correlations Professor Sandstrom demonstrates) still tells us little about why they switched. And when we look for an answer to this question we must still seek it in some fundamental difference between the two parties. If not, then we shall be obliged to do as Professor Loubere does and put it down to environmental factors, specifically the vine. Which still leaves us with no means of accounting for the decline of the Radicals. However, the correlations may prove less useful than they seem. What Professor Sandstrom neglects to observe is that in the I898 election in the Brignoles arrondissement, where he shows the Radical Rousse obtaining 66 % of the second round ballots, 40'4 % of the electorate abstained, a 4 % increase on the abstention rate in the first round. The abstention rate in I902 in the same district was very nearly as high, but it was the Socialist, Vigne, who won.' The Development of Socialism in France: The Example of the Var

During the first half of the French Third Republic, before 1914, certain regions of France established themselves as ‘red’, areas where the extreme left of the political spectrum could rely on strong and regular popular support. One of the outstanding features of this geographical ‘partition’ of French politics was the extent to which the ‘red’ areas were located in the countryside, notably in the departments of small peasant property in the south. Radicals, socialists and latterly communists have all benefited from this fact of French political life, consistently carrying at elections departments such as the Creuse, the Haute Vienne, the Allier, Gard, etc. Contemporaries and historians alike have observed this phenomenon with some surprise, and we are now witnessing a concerted effort by French historians and political scientists to find convincing explanations for it. This article is intended as a contribution to the continuing debate.

Problems and Prospects of Democratic Socialism in France and Italy

IN FRANCE AND ITALY, the presence of large Communist parties and the hidebound conservatism of the middle classes have combined to pose a serious problem for democratic Socialism. In France, the SFIO (Section Francaise de l'Internationale Ouviere) has been able to remain unified but ranks far behind the Parti Communiste Franfais (PCF) in membership and voting strength. Italian Socialism is relatively stronger but is split into two mutually antagonistic camps: the Partito Socialista Italiano (PSI), led by Pietro Nenni, is closely allied with the Italian Communist Party, while the Partito Socialista Democratico Italiano, led by Giuseppe Saragat, is firmly opposed to any collaboration with the Communists. Despite certain differences, the situations in both countries are roughly comparable: the absence of a powerful and independent Socialist movement serves as a barrier to the reforms which both societies so urgently need.
