Major Trends in Today's Intelligent Robotics in Light of the Creation of Collaborative Artificial Intelligence

Robotics and advances in artificial intelligence are breakthrough innovations with considerable promise and the potential to radically change the economic and social aspects of society. Research on the development of robotics is still scarce. This article fills the gap by analyzing the creation and diffusion of robotics innovation and the role of intellectual property in this process. The robotics innovation ecosystem is based on cooperative networks of independent specialists, scientific organizations, and companies. The state plays a significant role in supporting the innovation activity in the considered sphere, first of all, through grant financing, placement of defense orders and implementation of national strategies of robotics development. Competitions and prizes are an important incentive for creating innovations. Patenting is used by companies to protect intellectual property from encroachment by third parties, to ensure freedom of action, to license technology, and to protect against prosecution. The industrial revolution has changed the very notion of means and means of production in the minds of the masses in such a way that the process of robotization and the introduction of artificial intelligence in different areas of life has become inevitable. The article presents an analysis of possible ways of disclosing the concept of "artificial intelligence" as a legal category and its correlation with the concept of "robot", considers the issues of legal responsibility for the performance of work by artificial intelligence, studies the possibility of recognizing the holder of artificial intelligence work as a subject of law.

The role of intellectual property in the post-war development of the health care sector

Understanding the role and necessity of the use of intellectual property in the field of medicine is the basis for the proper development of this field in the postwar period, as well as for the entire healthcare system. Therefore, the purpose of the study was to determine the impact and prospects of the use of intellectual property in the development of the Ukrainian health sector, post-war. The methodological basis of the work consists of general and special scientific methods: analysis and synthesis, generalization, dialectical, axiological, legal-formal, legal-comparative and structural system. The result of the work shows the necessity of using heterogeneous objects of intellectual property, in particular, those in the field of copyrights and patents, for adequate reform and effective modernization of the health sector. It is concluded that intellectual property is designed not only to ensure the property and non-property interests of the subject of the specified property, but, in addition, is intended to ensure the needs of society in general in the appropriate sphere, where the objects of intellectual property find their concrete application.

Role of intellectual property in the development of the state’s innovation potential

The war poses serious challenges to the economy, national security, and development of the country as a whole, and innovation can be an important tool in overcoming these challenges. The research aims to study the impact of intellectual property on stimulating and promoting innovative development in the context of technological progress. The methods of scientific cognition used include analysis, synthesis, deduction, comparison, generalisation, and systematisation; a systematic approach was applied to create a comprehensive methodology for analysing the situation in the intellectual property market. The study investigates how intellectual property can stimulate scientific research, promote the development of new technologies, increase competitiveness within the state and contribute to economic growth. The study analyses the works of Ukrainian scientists that have a positive impact on the development of Ukraine’s innovation potential. The author presents an opinion on the need to develop and improve the protection of intellectual property rights, as this will facilitate the discovery of new technologies and the involvement of scientists in their development. The author discusses the issue of establishing the High Court of Intellectual Property and identifies the advantages and disadvantages that may arise with the introduction of such a body. The author substantiates the position on encouraging and conducting outreach to the public to involve scientists and specialists in the discovery and development of new technologies, and exchange of experience, and also emphasises the need for open educational and scientific events that will contribute to the development of Ukraine’s innovation potential. The author considers various methods of encouraging the population to discover new technologies and work in this direction, such as legal mechanisms that protect intellectual property rights holders from unfair competition, namely administrative and criminal liability. The practical value of the results obtained is that they reveal in detail the problematic issues of the innovation potential of the state, as well as identify areas for improvement and provide recommendations for the productive development of the digital state

Designing Intellectual Property Law and Creative Industry Course Syllabus for Creative Arts Undergraduate Students

Despite the role of intellectual property as the catalyst that transforms creative activity into creative industry, studies report that creative arts students are not adequately exposed to intellectual property law during their undergraduate studies. The rapid shift of creative industry from conventional to digital economy, requires evaluation of intellectual property course offerings for undergraduate creative arts students. Lack of in-depth knowledge and understanding in applying intellectual property law in creative industry has hindered the protection and economic exploitation of their creative works at the earliest possible stage of their creations. This paper aims to design a course syllabus for intellectual property law and creative industry that prepares and empowers Universiti Teknologi MARA (UiTM) creative arts undergraduates’ participation in creative industry. This paper compared the course syllabuses of universities that offer intellectual property law courses specially designed by universities and learning centre for the students, authors, artists, and designers who are involved in creative industry. The comparison includes the course objectives, course learning outcomes, course description, syllabus content, teaching methodology, and course assessment. The comparative study findings contribute towards designing intellectual property law and creative industry course syllabus for creative arts undergraduates of UiTM and also beneficial to other universities.

Do patent pledges accelerate innovation?

This paper estimates the effect of patent pledges, commitments made voluntarily by patent holders to limit the enforcement of their patents, on follow-on inventions. Patent pledges have been gaining popularity in recent years thanks to the highly visible pledges of companies such as Google and Tesla. Extant literature discusses the legal and strategic implications of patent pledges, but we know very little about the societal aspects of such pledges. The empirical analysis exploits original data on over 1200 patents pledged from across technological fields between 2005 and 2017. We implement recent advances in conditional difference-in-differences estimators for staggered, dynamic event study settings to account for unobserved endogenous selection into a patent pledge. We build the matched control group of not-pledged patents using similarity measures of the full text of patent documents. The results suggest that patent pledges spur technological progress, as reflected by increased citations received by the pledged patents. The effect is particularly salient for the more open patent pledges and the higher-quality and more novel patents. The results bear implications for discussions about the role of intellectual property on technology diffusion.

The National Education Policy 2020 is a fantastic move by the Indian government to transform the educational system. The aim to make higher education more multidisciplinary and comprehensive like making curriculum more adaptable, developing e-courses in regional languages, and introducing skill-development course are appreciated. However, the policy does not specifically mention intellectual property, innovation, and entrepreneurship—key elements of transferring higher education institution into a research and innovation focussed institution, which is the need of the hour. The current study looked at the role of intellectual property, research, innovation, and entrepreneurship and made some recommendations on how to integrate them into academic curricula so that NEP's goals can be met fully and faster.

 The article examines the role ofintellectual property, in particular, the Institute of Secret Inventions in the developmentof the Japanese economy, ensuring the national economic security of the state.An analysis of the new Law on Strengthening National Security through ComprehensiveEconomic Measures, adopted on May 11, 2022, is given. The organizational andeconomic mechanism for ensuring measures aimed at strengthening Japan's national economic security is considered: a system that ensures a stable supply of critical materials,a system for supporting the development of critical technologies, and a secretpatent system. Japan's Economic Security Act gives the Japanese government theright to determine economic threats and risks associated with foreign economic activity.Focusing on four areas of economic security — supply chains, basic infrastructure,advanced technology and the publication of patents on sensitive technologies — thelaw allows the national government to intervene in Japanese companies' deals withforeign companies. It is concluded that the economic and legal institution of secret inventions,which directly affects national security, will gain more and more importance.And certain provisions of the Law can be used in law-making and law-enforcementactivities in Ukraine: a system for supporting the development of critical technologies,designated patent classifications (Designated Patent Classifications) in thefields of technology that can affect national security, guidelines for non-disclosure, securityexpertise, a system of preliminary determination secrecy, government compensationfor restrictions in the form of payment of «ordinary damages», sanctions forleaking undisclosed patent information.

Debate regarding the contribution of Intellectual Property (IP) rights to lessening climate change is intensifying. On one side, IP optimists emphasize their function in encouraging investment in Research, Development and Commercialization. However, alternative view, principally associated with developing countries, sees the monopoly rights embodied in IP as a barrier to technology adoption and international transfer and this has led to a dilemma in IP rights ethically responding to global climate change.The role of intellectual property rights with regards to climate change has remained a divisive issue. Not only has no agreement been reached in this area, but even the path to a constructive and meaningful discussion seems elusive. Unless the role of intellectual property is addressed in a constructive and balanced manner, the potential for achieving sustainable and realistic outcomes from the climate talks could be compromised.This article explored the complex relationship between IP rights and climate change through technology-based reductions in emissions and with reference to sustainable development laws. It also considers the role IP rights can play in delivering technological change to abate the issues of climate change crisis by arguing that climate change is legally disruptive, with existing legal doctrines and frameworks forced to confront, respond, and perhaps even evolve to respond to climate change, beyond the application and incremental development of existing rules and doctrines written in the context of linkages between private international law and public international law.It concludes by outlining some plausible strategies that are necessary in resolving the dilemma associate with IP rights ethically responding to global climate change.

Such approach, enhanced with external partners involvementinto the innovations process, helps the innovative technologies to move remarkablyfaster through the lifecycle. It is also emphasized that the approach enabling externalaccess to the companies’ innovations, need a concept to be set up, with focus onintellectual property rights protection. The author draws attention that the key roleof legal instruments for intellectual property protection, is to minimize the risk forthose companies which contribute to the innovations market development. It is clarifiedthat within such a concept, the innovation activity companies provide their partnersthe right to use the intellectual assets, which may be either already in use bysuch companies or idle to use. The Role of Intellectual Property in Innovation and Economic Growth of Indian MSMEs

Small and medium-sized enterprises (SMEs) are backbone of India’s manufacturing industry and play an important role in India’s stable money supply growth. There are more than billions of SMEs in India, with an investment of more than 1 billion rupees. The sector has recorded strong growth during past fiscal years and contributes approx. 6.11 per cent to country’s manufacturing GDP and 24.63 per cent of the GDP from service activities as well as 33.4 per cent of India’s manufacturing output. Approximately 70 per cent of employment growth comes from Asian MSMEs, which account for 90 per cent of Indian industrial companies and 40 per cent of manufacturing value added. India is estimated to have more than 13 million SMEs with 42 million employees. For these reasons, it is very important for these companies to invest in their intellectual property (IP). By introducing unique brand and product names, each retailer can ensure the high replacement cost and market position of its products and/or services. IP and its worth are usually neglected. IP is a major aspect in daily business practices in an increasingly knowledge-based sector. New technologies, brands and innovative designs are introduced to the market nearly every single day, as a result of human continual innovation and creativity. As a result, the necessity of intellectual property rights to MSMEs in product development as well as some success stories is reviewed in this manuscript. This article also showed how IP has evolved into a business tool to counter the challenge that MSMEs confront in applying the IP system.

Impact of Patents on Pharmaceutical Companies and Public Health: Critical Study

This paper undertakes a review of available studies to provide a perspective on the role of Intellectual Property (IP) protection in developing health care innovations in India. The relevant literature in the context of India has followed two strands: some studies focus on the implications of the new IP regime on access to health care, while others explore the implications of IP on innovation in general and medical innovation in particular. 1.product innovations in drugs; 2.process innovations in pharmaceutical industry; 3.new drug delivery mechanisms, bio-enhancers that improve bio-availability/efficacy and dosage forms; 4.product innovations in medical equipment and devices; 5.innovations in the delivery of health services; and 6.Policy innovations to enhance access to health care. “It is not always possible to attribute all the aforementioned changes to the change in the IP regime as firms and governments strategically innovate for a variety of reasons. However, in this review, we focus on two types of “innovative responses” that may affect health care access and innovation, as these may be, at least partly, a response to the changes in the IP regime”: 1.Changes in innovation inputs and outputs, reviewing studies that capture implications of IP for changes in research and development (R&D), technology licensing/collaboration, patents, and other innovations at the firm level. 2.Institutional/policy innovations in the health care sector to provide better access to health care. For the purpose of this article, all policy experiments in this space are seen as ‘innovative’ even though these may not be globally ‘novel’. The following section provides a broad overview of the Indian pharmaceutical industry and health care provision in India. The “Changes in the IP regime and IP policy innovations” section briefly discusses the changes in IP policy in recent years to help appreciate other policy and health-related innovations. Q&A With Devon Energy It’s Time To Talk About IP Protection

Devon Energy considers its development of a new completions technology called Sealed Wellbore Pressure Monitoring (SWPM) to be one of the shale sector’s biggest breakthroughs in subsurface engineering. The approach to fracturing diagnostics represents a class of next-generation tools designed to make on-the-fly stimulation designs more practical than ever. But the innovation has done something else, too. It has raised old questions within a relatively new sector about the role of intellectual property (IP) protection. When SWPM was introduced to petrotechnicals outside of Devon, some initially questioned how or why the technique needed to be patented at all. The ingenuity behind SWPM could be boiled down to solving a math problem: How much fluid is pumped during the hydraulic fracturing treatment of one well before it travels across a known distance and applies pressure to the unperforated casing of a neighboring shut-in well? The ability to answer this question rapidly and with surety holds great value for any developer of multiwell pads. But, as some wondered, was this simply a formula that could be repeated and used as freely as a decade’s old equation found in a textbook? Was Devon being too protective over its discovery? Or was it simply being prudent? Earlier this year, Devon was granted a US patent for SWPM, the end of a process that began on a well pad in 2017. In the meantime, the company shared rights with other operators for field trials before striking a deal last summer with software developer Well Data Labs to market SWPM to the rest of the unconventional business. The drivers behind Devon’s IP strategy, what it learned while patenting SWPM, and what it hopes others in this space will take away from that experience are shared here by Chad Holeman, corporate counsel at Devon, and Kyle Haustveit, a co-inventor of SWPM and a subsurface engineering manager at Devon. JPT: Can you begin by explaining your philosophy around IP protection and how SWPM reflects that? Chad Holeman (CH): We talk about confidential and proprietary information with some degree of frequency. As an organization, I think that we’re further along on the spectrum of maturation as it relates to understanding what that means and safeguarding that information to the very best of our ability. One key is that you need to be able to differentiate trade secrets, or confidential proprietary information that you want to keep close to the vest, from the inventive concepts that you want to protect and can also commercialize, potentially monetize, or gain some other type of competitive advantage from. Inventive concepts such as SWPM fit that mold. Kyle Haustveit (KH): I think the concept of leaving value on the table is one of the biggest reasons we do this. A lot of operators have made massive investments into the digital revolution and multimillion-dollar investments into diagnostic programs to understand how we are breaking and draining the rock with our stimulations. Intellectual property valuation: developing a model for patent valuation

With the growing knowledge of economics, the role of intellectual property in the development of international businesses and the boom of the national economy has become increasingly pronounced. There are many items on the intellectual property list, but the patent may be the most important intellectual property. Patent rights that bring patent owner immunity are very valuable. These licenses have been tradable in certain markets, like many other economic markets, and one of the concerns of technology researchers has always been to calculate the value of patents and to decide whether or not to buy them. The present study has developed a system for patent valuation. In the first step, the decision to invest or not invest in intellectual property (policy making) is examined using Ohlsen's model. In the second step, the patent valuation is done by using the real option valuation methods. Implementation of Ohlsen's model in companies listed on the Tehran Stock Exchange has highlighted the importance of advertising as one of the customer-centric intellectual property of the share price. in second step, a patent is valued in terms of the option to assign and simulate future patent cash flows using the average return process.

Covid-19 and the Role of Intellectual Property: Position Statement of the Max Planck Institute for Innovation and Competition of 7 May 2021

In this Statement, the authors take a position on the waiver of intellectual property (IP) protection currently being considered by the members of the World Trade Organisation. The waiver was initiated by India and South Africa as a measure to enable rapid access to affordable medical products that are necessary to combat Covid-19. The initiative gained momentum after the US decided to support it. The authors do not consider this path to be expedient. The Statement presents factual and legal arguments why a comprehensive waiver of IP protection is unlikely to be a necessary and suitable measure towards the pursued objective. Overall, it argues that IP rights may so far have played an enabling and facilitating rather than hindering role in overcoming Covid-19. The global community might not be better off if IP rights are waived, neither during nor after the pandemic. There are more efficient and direct ways to supply developing countries with vaccines quickly – if the industrialised countries are willing to do their share.
