Local Agents of International Justice? On the Role of Subnational Units in Refugee Protection

Refugee protection depends, minimally, on the identification of agents capable of discharging international obligations in this area of international law. Commonly discussed “agents of justice” include states, IOs, and NGOs. This article focuses on a different set of actors: subnational units (cities, states, and provinces in federal States) and the legal mechanisms they may use to discharge international obligations in the area of refugee protection. I advance three distinct theoretical models for understanding subnational units’ responsibilities vis-à-vis international law: (1) derived delegated responsibilities; (2) derived back-up responsibilities; and (3) assumed responsibilities. I conclude by sketching some ways in which subnational units could play an even more salient role in the promotion of international law.

The UN75 Declaration, Our Common Agenda and the development of international law

AbstractIn the declaration on the commemoration of the seventy-fifth anniversary of the United Nations, Member States requested that the Secretary-General provide recommendations to advance “Our Common Agenda” and to respond to current and future challenges. The Secretary-General issued a report entitled “Our Common Agenda” on 5 August 2021, which, among others, reinforces the role of the United Nations as a place of choice for the development of international law, also putting in context the role and specific prerogatives of the Secretary-General in the promotion of international law. The declaration and “Our Common Agenda” have also presented an opportunity to counter sentiments regarding a supposed general decline in respect for international law.

Multilateral Development Banks and Sustainable Development: On Emulation, Fragmentation and a Common Law of Sustainable Development

AbstractMultilateral Development Banks (hereinafter MDBs) have evolved from avoiding non-economic considerations, as required in most of their charters, to officially supporting sustainable development. This transformation is due not only to international law, civil society pressure or internal adjustments, but in part to the emulation phenomenon between the international effort for sustainable development made by international conferences and commissions and the sustainable development effort by MDBs. The paper first examines this emulation phenomenon and its strong impact on MDB creation of substantive instruments – the environmental and social safeguards – and of procedural instruments – the accountability mechanisms – for the integration of sustainable development. Following this discussion, the second part points out that MDBs’ environmental and social safeguards still differ substantially, revealing a fragmentation in MDBs’ normative understanding of sustainable development. After presenting the arguments supporting this fragmentation, the last part of the paper argues in favor of the harmonization of MDBs’ environmental and social safeguards, resulting in the creation of a common law of sustainable development, the promotion of international law and the facilitation of investments.

Fostering a Scholarly Network in International Law: An Introduction to the Special Issue

This special issue of the Alberta Law Review is devoted to the discussion of current topics within the field and discipline of international law, including matters of international trade and investment law, international development, peace and security, international criminal law, and the international protection of human rights. The publication of this issue represents the culmination of an extraordinary intellectual exchange between four societies dedicated to the development and promotion of international law, which together represent five countries and attract membership from lawyers within academia, government, and private practice. The “Four Societies” initiative stems from an initial partnership in the early 1990s between the American Society of International Law (ASIL), the Canadian Council on International Law (CCIL), and the Japanese Society of International Law (JSIL), which was later expanded upon during the current decade to include the Australian & New Zealand Society of International Law (ANZSIL). Without the support of these Four Societies, this special issue, and the two-day conference at which the articles were first presented, would not have taken place.

The goal of international law is to protect human rights, and human rights are to be enjoyed, presumably on a global basis, under the protection of a universally binding rule of inter- national law. To be for human rights is necessarily to be for international law, and vice versa. The central purpose of this essay is to argue that not only is the presumed positive relationship between international law and human rights not necessarily the case, but that the relationship is of a more tense and conflictual nature. In some cases, there is a negative or in- verse relationship between law and human rights. While there is an as- sumption that the promotion of international law and the promotion of human rights are essentially part of the same project of modernity, this is not the case. At a rhetorical level, they appear to be one and the same thing, but at a practical level – literally, at the level at which international law is practiced and at which human rights is practiced – international law and human rights constitute different value-spheres in the contempo- rary world.] </span></p></div></div></div>
