Ethical Dilemmas Faced by Military Health Personnel During High-Intensity Conflict: The Crucial Issue of Triage.

Russia's invasion of Ukraine has triggered the biggest conflict in Europe since the Second World War. It has forced countries to prepare for engagement on a massive scale, namely, a high-intensity war between nation states. A potential massive influx of wounded personnel risks saturating logistical supply chains and requires changes to not only medical care but also a paradigm shift. In this context, the principle of distributive justice is key. The aim is to save as many lives as possible through triage, which consists in "doing the greatest good for the greatest number." This idea is fundamental, as an emergency that has passed is no longer an emergency. However, international texts and treaties not only underline that the sole criterion for triage is clinical severity, but they also fail to take into account the patient's status (civilian, friend, and foe). In a high-intensity warfare situation, these texts, and the medical-surgical triage criteria they provide are insufficient, as caregivers may be required to make decisions based on the status of the patient. The need to make such choices could cause psychological suffering among military caregivers, as individuals are recurrently faced with difficult ethical dilemmas. One way to prevent this happening is to provide predeployment training in wartime medical ethics. The latter would include both instruction in international humanitarian law and practical simulations of clinical situations where the person is faced with an ethical dilemma.

Comparative view of Sandel's Distributive Justice Theory

In Western political thought, distributive justice has always been an important issue. Utilitarianism, liberalism and communitarianism represent three different views of distributive justice, but they try to solve the same problem, the inequality of income and wealth. Utilitarianism aims at welfare maximization, liberalism takes respect for freedom as its starting point, and communitarianism, represented by Sandel and MacIntyre, advocates Aristotle's deserved theory with the aim of promoting virtue and taking unity as the banner against inequality. This paper takes Sandel's Liberalism and the Limits of Justice as the core of the study, captures the central proposition of distributive justice from the standpoint of communitarianism, introduces the Marxist distributive justice principles of Marx and Cohen, and compares and interprets the characteristics of Sandel's communitarian distributive justice theory from a perspective different from utilitarianism and liberalism. Finally, based on the principles of Marxist view of justice, this paper briefly expounds the theoretical value, limitation and practical possibility of Sandel's distributive justice theory and communitarian view.

Reflective equilibrium in practice and model selection: a methodological proposal from a survey experiment on the theories of distributive justice

In political philosophy, reflective equilibrium is a standard method used to systematically reconcile intuitive judgments with theoretical principles. In this paper, we propose that survey experiments and a model selection method—i.e., the Akaike Information Criterion (AIC)-based model selection method—can be viewed together as a methodological means of satisfying the epistemic desiderata implicit in reflective equilibrium. To show this, we conduct a survey experiment on two theories of distributive justice, prioritarianism and sufficientarianism. Our experimental test case and AIC-based model selection method demonstrate that the refined sufficientarian principle, a widely accepted principle of distributive justice, is no more plausible than the prioritarian principle. This tells us that some changes of certain intuitions revolving around sufficientarianism should be examined (separately) based on the findings of the survey experiment and AIC model selection. This shows the potential of our approach—both practically and methodologically—as a novel way of applying reflective equilibrium in political philosophy.

The Concept of Social Justice in Mine-Host Community Involvement and Benefit Accrual: Reflections from Mineral Extraction in Zimbabwe

Minerals play a vital role in societal and economic growth. As finite and non-renewable resources, minerals inevitably diminish upon extraction. Consequently, there is an expectation that the extraction process should involve and benefit the local communities hosting these resources. Despite expectations of benefitting local communities, mineral extraction often results in more economic, social, and environmental burdens than advantages for them. This contribution is centred on a theoretical inquiry, employing the concept of social justice to explore and mitigate the disparities in the distribution of costs and benefits experienced by mine-host communities. It aims to balance the inequities, emphasising the principles of distributive, procedural and remedial justice to reconcile the losses and gains in a fair and equitable manner

Ethical triage in public health emergency facilities: distributive justice – a decision model

PurposeA new triage method, MBCE (Medical Bio Social Ethics), is presented with social justice, bio, and medical ethics for critical resource distribution during a pandemic. Ethical triage is a complex and challenging process that requires careful consideration of medical, social, cultural, and ethical factors to guide the decision-making process and ensure fair and transparent allocation of resources. When assigning priorities to patients, a clinician would evaluate each patient’s medical condition, age, comorbidities, and prognosis, as well as their cultural and social background and ethical factors.Design/methodology/approachA statistical analysis shows no interactions among the ethical triage factors. It implies the ethical components have no moderation effect; hence, each is independent. The result also points out that medical and bioethics may have an affinity for interactions. In such cases, there seem to be some ethical factors related to bio and medical ethics that are correlated. Therefore, the triage team should be careful in evaluating patient cases. The algorithm is explained with case histories of the selected patient. A group of triage nurses and general medical practitioners assists with the triage.FindingsThe MBCE triage algorithm aims to allocate scarce resources fairly and equitably. Another ethical principle in this triage algorithm is the principle of utility. In a pandemic, the principle of utility may require prioritizing patients with a higher likelihood of survival or requiring less medical care. The research presents a sensitivity analysis of a patient’s triage score to show the algorithm’s robustness. A weighted score of ethical factors combined with an assessment of triage factors combines multiple objectives to assign a fair triage score. These distinctive features of the algorithm are reasonably easy to implement and a new direction for the unbiased triage principle.Originality/valueThe idea is to make decisions about distributing and using scarce medical resources. Triage algorithms raise ethical issues, such as discrimination and justice, guiding medical ethics in treating patients with terminal diseases or comorbidity. One of the main ethical principles in triage algorithms is the principle of distributive justice.

Co-workers’ perceptions of the distributive justice of idiosyncratic deals – the roles of content, timing, and justice sensitivity

Research to date creates a predominantly positive image of idiosyncratic deals (i-deals). However, since i-deals lead to differences in employment relationships, they can trigger perceptions of unfairness and negative reactions among co-workers, thereby posing a threat to the overall effectiveness of i-deals. Against this background, it is important to gain more insights into how co-workers’ perceptions of distributive justice are shaped. Building on distributive justice theory and integrating distributive justice principles with the roles of emotions and personality, this study investigates three factors that are likely to influence co-workers’ perceptions of the distributive justice of an i-deal: the i-deal’s content, the negotiation’s timing, and co-workers’ justice sensitivity. The results of the vignette-based, between-subjects quasi-experimental study with 650 employees show that these three factors influence co-workers’ perceptions of an i-deal’s distributive justice. In addition, the results of the study reveal interaction effects between the factors under investigation. By examining what influences co-workers’ perceptions of distributive justice, this study contributes to a better understanding of i-deals from a third-party perspective and highlights that some types of i-deals, in terms of content and timing, should be approached with particular caution by supervisors.

Justice, inclusion, and incentives

How does justice affect individual incentives and efficiency in a political economy? We show that elementary principles of distributive justice guarantee the existence of a self-enforcing contract whereby agents non-cooperatively choose their inputs and derive utility from their pay. Chief among these principles is that your pay should not depend on your name, and a more productive individual should not earn less. We generalize our analysis to incorporate inclusivity, ensuring basic pay to unproductive agents, implemented through progressive taxation and redistribution. Our findings show that without redistribution, any self-enforcing agreement may be inefficient, but a minimal level of redistribution guarantees the existence of an efficient agreement. Our model has several applications and interpretations. In addition to highlighting the structure of economies and organizations in which fairness and efficiency are compatible, we develop an application to the formation of rent-seeking political alliances under the threat of fake news.

Defining interventions and metrics to improve diversity in CNS clinical trial participation: A SNO and RANO effort.

Despite major strides in cancer research and therapy, these advances have not been equitable across race and ethnicity. Historically marginalized groups (HMG) are more likely to have inadequate preventive screening, increased delays in diagnosis, and poor representation in clinical trials. Notably, Black, Hispanic, and Indigenous people represent 30% of the population but only 9% of oncology clinical trial participants. As a result, HMGs lack equitable access to novel therapies, contradicting the principle of distributive justice, as enshrined in the Belmont report, which demands the equitable selection of subjects in research involving human subjects. The lack of clinical trial diversity also leads to low generalizability and potentially harmful medical practices. Specifically, patients with brain cancer face unique barriers to clinical trial enrollment and completion due to disease-specific neurologic and treatment-induced conditions. Collectively, the intersection of these disease-specific conditions with social determinants of health fosters a lack of diversity in clinical trials. To ameliorate this disparity in neuro-oncology clinical trial participation, we present interventions focused on improving engagement of HMGs. Proposals range from inclusive trial design, decreasing barriers to care, expanding trial eligibility, access to tumor profiling for personalized medical trials, setting reasonable metrics and goals for accrual, working with patient community stakeholders, diversifying the neuro-oncology workforce, and development of tools to overcome biases with options to incentivize equity. The diversification of participation amongst neuro-oncology clinical trials is imperative. Equitable access and inclusion of HMG patients with brain tumors will not only enhance research discoveries but will also improve patient care.

Engineering for Human Rights: The Theory and Practice of a Human Rights–based Approach to Engineering

The welfare of society and the relationship between people and the natural environment are all directly impacted by engineering work, and codes of ethics are central to the profession. Yet many engineers struggle to incorporate these principles into their daily work because such codes typically emphasize professional conduct without reflecting on the role of engineering within such complex social and environmental systems. In this paper, we propose a human rights–based approach to engineering anchored in four core principles of distributive justice, broad participation, explicit consideration of duty-bearers, and accountability for all actors involved. This is a new paradigm that draws on universal principles to shape individual ethical obligations and the norms of the profession to prevent risk, enhance access to the benefits of technology, and redress social and environmental harms resulting from engineered products or processes. This paradigm could transform both university education and professional practice by harmonizing existing engineering ethics with core human rights obligations to respect, protect, and fulfill human rights.

From kilowatts to cents: Financial inclusion of citizens through Dutch community energy business model configurations

Community energy initiatives (CEIs) emphasize citizen empowerment, equitable distribution of energy transition costs and benefits, and the importance of local knowledge. While CEI goals align with energy justice principles, they have been criticized for not fully incorporating distributive justice, particularly the distribution of the benefits of a sustainable energy transition. Therefore, they may potentially perpetuate income inequalities. There are insufficient studies to conclusively determine whether CEIs perpetuate or address income inequalities. Moreover, the integration of transition studies, energy justice and business model literature is lacking, hindering effective analysis of CEI configurations that address income inequalities. This paper aims to connect the sustainability, energy justice and business model literature by dissecting the business model configurations of CEIs and assessing the inclusiveness of these components. To do so, we develop and employ an adapted business model canvas that incorporates societal and environmental considerations in the value proposition, value creation and delivery and value capture. The canvas is used to determine whether sustainability and energy justice considerations, particularly distributive justice principles, are embedded in the CEI business models. The research is focused on the Netherlands, a country with a high number of CEIs. However, the study may yield insights relevant to other countries and CEIs, informing the integration of principles for societal inclusion in their own contexts. We utilize a mixed-method approach, including interviews, desk research and surveys, to ensure robust analysis through data triangulation. The study finds that there are elements of CEI business model configurations that are aligned with energy justice principles. However, models specifically targeting and aligning with minimum income social groups are rare.

Building within planetary boundaries: setting and assessing absolute sustainability targets at the building level

The planetary boundaries (PBs) are a widely used framework defining a “safe operating space” for environmental sustainability at the global level. However, they do not straightforwardly translate into indicators applicable in a building project. This paper proposes a procedure to set and assess absolute sustainability targets related to the PBs in a building project, exemplified in the case of Denmark. The first step is to ensure that the targets and the assessment method use comparable indicators. Common building life cycle assessment (LCA) tools use impact categories that do not directly match the PBs. Two options are considered to address this issue. Dedicated characterization factors can be used to convey LCA results in indicators consistent with the PBs. Alternatively, PB targets can be converted into LCA impact categories. Then, several distributive justice principles are reviewed to allocate a share of planetary sustainability targets to an individual country, to the housing sector within that country, and to an individual project. We argue that principles that conserve existing unsustainable paradigms are not appropriate to set planetary sustainability targets, and propose a novel approach for sectorial allocation based on sufficientarianism and “decent living” scenarios. Finally, challenges related to the assessment of these targets are highlighted. In particular, the paper draws attention to differences in system boundaries between the LCA and the targets.

Social justice orientations: Exploring their impact on poverty attributions and support for social protection

AbstractDistributive justice remains a central issue in contemporary welfare states, even more during times of economic hardship and social uncertainty. In this article, we analyze how attitudes toward the principles of normative distributive justice (equality, need, equity, and entitlement) are related to support for the redistribution of resources (Study 2) and attitudes toward social protection policies (Studies 1 and 3). In Study 1 (N = 325), we found that equality and need positively predicted attitudes toward social protection policies while equity and entitlement negatively predicted these attitudes. In Study 2 (N = 49,519), using data from Round 9 of the European Social Survey, we replicated this linking normative orientation toward different distributive justice principles with support for redistribution. We replicated these results in Study 3 (N = 494). In addition, we explored the role of attributions for poverty in the relationship found in Studies 1 and 2. Attributions for poverty mediated the relationship between orientations toward justice principles and attitudes toward social protection policies.

Anthropological grounds of climate equity principles

As repeatedly acknowledged since the ratification of the United Nations Framework Convention on Climate Change in 1992, the equitable allocation of climate burden among parties is at the heart of climate negotiations. But while equity principles have been extensively addressed in the literature on climate policy, their fundamental underlying values remain elusive. Drawing on anthropology and relational models theory, this Perspective paper aims to shed light on this topic by showing that any climate equity principle corresponds to one of the four relational models people in all cultures use to implement their exchanges – and thus corresponds to their associated principles of distributive justice. Such a clarification may facilitate academic research on this topic, as well as the definition, the acceptance and, finally, the effective implementation of climate policies.

Merit first, need and equality second: hierarchies of justice

AbstractThe question of “Justice” still divides social research, moral philosophy, and public discourse. Three principles of distributive justice (allocation rules) occupy center stage in the debate: merit (equity, proportionality), need, and equality. Yet their relation remains diffuse, and current theory does not inform political practice. Here, we aim to develop a coherent picture with an interdisciplinary analysis. From an evolutionary point of view, the foundational principle of justice is reciprocity in social exchange (what corresponds to merit). But besides being just, justice must be effective, efficient, and communicable, thereby making justice rather a social bargain and an optimization problem. Social-psychological insights (intuitions, rules of thumb, self-bindings) can inform us when and why the two allocation principles need and equality are more likely to succeed than merit would. But both are governed by reciprocal considerations, and self-bindings help to interpret altruism as “very generalized reciprocity.” Regarding politics, the reciprocal social norm Meritocratic Principle can be implemented, and its controversy avoided, by concentrating on “non-merit,” i.e., institutionally draining the wellsprings of undeserved incomes (economic rents). Avoiding or taxing away economic rents is an effective implementation of justice in market economies.

Two faces of benefit generosity: comparing justice preferences in the access to and level of welfare benefits

Abstract Welfare generosity is a multidimensional concept that refers to both the access to benefits and the levels of benefits (in terms of the amounts paid to recipients). However, in analyses of public support for welfare, this distinction has been largely disregarded. To gain a fuller picture of attitudes towards welfare redistribution, the current study explicitly compares the two elements and examines which distributive justice principles—that is, equality, equity, and need—are preferred to govern, on the one hand, the access to benefits and, on the other hand, their levels. The article evaluates this distinction in two different distributive contexts (pensions and unemployment benefits) and contrasts social-structural as well as ideological dividing lines. For this purpose, data from the Belgian National Elections Study 2019 are analysed. The results indicate that the access to and levels of benefits are clearly distinct dimensions in public opinion, as different justice principles are preferred for the two policy dimensions. In addition, structural equation models illustrate that the access dimension is more ideologically structured, whereas preferences regarding the levels of benefits are more strongly stratified along social-structural lines. Overall, the results imply that social justice preferences are clearly different when considering the access to benefits or their level. This distinction should be taken into account in welfare attitude research.

Perlindungan Anak dari Kekerasan Ekonomi melalui Asuransi: Analisis Peran Otoritas Jasa Keuangan dalam Meningkatkan Jaminan Hak Anak

Purpose – This research aims to elucidate in detail how insurance can serve as a vital instrument in ensuring the rights of children and shielding them from the detrimental impacts of economic violence.
 Methods – The research methodology employed is a thorough literature review encompassing primary data sources from pertinent books, journals, and legal texts related to the research topic. Subsequently, the acquired data is subjected to descriptive-analytical analysis to unveil the underlying objectives of the research.
 Findings – The results indicate that the security provided by insurance contracts is instrumental in safeguarding the rights of children, particularly in situations where parental figures have passed away or retired from employment. While the fulfillment of children's rights may not have reached an optimal level, their financial needs can be met to a reasonable extent, thanks to the role played by insurance. Additionally, this research underscores the crucial role played by the Financial Services Authority (OJK) in upholding justice and ensuring effective protection for children who are vulnerable in the context of economic violence. The OJK is tasked not only with receiving complaints but also with resolving disputes related to insurance businesses and facilitating the settlement of insurance claim disputes in accordance with the agreements reached by the involved parties.
 Research implications – The theoretical implication of this research lies in its contribution to broadening our comprehension of the role of insurance in the realm of child protection. Moreover, its originality is underscored by the integration of distributive justice principles and contract theory, enriching our understanding of this dynamic interplay within the context of child protection mechanisms.
 Originality/value – In conclusion, this research underscores the significance of collaborative efforts among governmental bodies, financial institutions, and communities in enhancing the safeguarding of children from economic violence, utilizing insurance as a potent tool for protection.

Mobility as a service and socio-territorial inequalities: A systematic literature review

Mobility as a service is a potential solution to mobility problems; however, it raises concerns about its relationship with socio-territorial inequalities (STIs). This paper contains a systematic literature review of real-world MaaS applications and their effects on STIs. From the principle of distributive justice, we adopted the Resources, Opportunities, Outcomes, and Wellbeing (ROOW) approach to assess cases. From 2009 papers on MaaS, we identified 20 that stood as real-world applications that considered equity impacts. Most studies were undertaken in Europe and Asia, neglecting countries in South America, Africa, and other low-income countries. They did not quantify the societal advantages of MaaS, while only a handful investigated the influence of MaaS over STIs. Results indicate that MaaS schemes contain at least three factors that may drive inequality: the lack of basic resources to enter the system, the systems’ limited geographic coverage, or MaaS users may simply not gain from the system’s intended accessibility benefits. In conclusion, MaaS could improve trip planning and access to new modes and low-density areas, but it is still perceived as expensive and only accessible to digitally literate people. This should be considered when defining MaaS governance, which remains (to date) underdeveloped, hindering private-public collaboration.

Ethical principles, challenges and opportunities when conducting genetic counselling for schizophrenia.

Ethical challenges of genetic counselling for schizophrenia include effective communication of critical scientific information in an easily understood manner by patients and relatives, and the ability to ensure communication is unencumbered by medical jargon. Levels of literacy in the target population may limit this process, making it difficult for patients to attain the desired levels of informed consent to make crucial decisions during genetic counselling. Multilingualism in target communities may further complicate such communication. This paper outlines the ethical principles, challenges and opportunities facing clinicians when conducting genetic counselling for schizophrenia and how these might be met, drawing on lessons from South African studies. The paper draws on reflections of clinician and researcher experiences gained from clinical practice or research on the genetics of schizophrenia and psychotic disorders in South Africa. The context of genetic studies in schizophrenia is used to illustrate the ethical challenges in genetic counselling for schizophrenia, both in clinical and research settings. Attention is also drawn to multicultural and multilingual populations, particularly where the preferred language lacks a well-developed scientific language of communication for some of the genetic concepts that have to be presented during the genetic counselling process. The authors describe the ethical challenges and how to address these to empower patients and relatives to make well-informed decisions despite these obstacles. Principles applied by clinicians and researchers during the genetic counselling are described. Potential solutions, including the establishment of community advisory boards to address potential ethical challenges inherent to the genetic counselling process, are also shared. Genetic counselling for schizophrenia still faces ethical challenges which require a balance of principles of beneficence, autonomy, informed consent, confidentiality and distributive justice, while striving to present accuracy in the science that guides the process. Evolution in language and cultural competency therefore needs to occur alongside scientific advances in genetic research. Key stakeholders need to partner and build capacity and expertise in genetic counselling through the provision of funding and resources. The goal of partnerships is to empower patients, relatives, clinicians and researchers to share scientific information in a manner guided by empathy while retaining scientific accuracy.

Article 33 paragraph (2) and paragraph (3) of the 1945 Constitution of the Republic of Indonesia regulates guarantees for the exploitation of electricity supply which is controlled by the state which is used for the maximum prosperity of the people. However, in an effort to increase the country's ability to supply electricity, the government provides opportunities for private business entities, cooperatives and non-governmental organizations to participate in the electricity supply business. Problems arise when there is a PT PLN (Persero) policy that limits the rights of private actors in supplying electricity. The problem in this study is how is the principle of justice in the implementation of regulations in the electricity sector towards private parties in the business of providing electricity? The research method used is normative juridical. The results of the study reveal that the principle of justice in the implementation of regulations in the electricity sector towards private parties in the business of supplying electricity is contrary to the principle of distributive justice. The actions of PT PLN (Persero) regarding making it difficult for the installed power capacity of the development of rooftop PLTS to a maximum of 15% in several regions are inseparable from the Indonesian ideology which is based on nationalist understanding which is more concerned with domestic interests. If PT PLN (Persero) could pay attention to the Constitutional Court Decision Number 111/PUU-XIII/2015 which states that the phrase "state control" accommodates the Constitutional Court not in the sense that the state owns it, but in the sense that the state only formulates it including regulatory aspects (regelendaad) , management (bestuursdaad), management (beheersdaad), and supervision (toezichthondensdaad).

The Emergence of a New Business Approach in the Fashion and Apparel Industry: The Ethical Retailer

This study sought to examine new marketing ethics (ME) practices that can foster strong moral grounding in the fashion and apparel retail firms to delineate a new approach within this industry. We built on the distributive justice and stakeholder orientation literature to conduct a multi-case study with 15 self-proclaimed ethical fashion and apparel retailers to identify whether and how they differ from traditional and fast fashion retailers. Several data collection techniques were used to gather the evidence (i.e., direct observation, physical and online interviews) combined with a netnographic approach (i.e., online observation of websites and social media content). Our findings show that these firms are guided by ethical-centered values, which are reflected in their product components, purpose, communication practices, and sourcing practices, which point to the emergence of a new business approach. We contribute to the macromarketing literature by identifying a new perspective on the role of morality in ME based on distributive justice principles and stakeholder orientation. We also propose a more refined definition of ethical fashion and apparel retailers.
