The article identifies the problematic issues of proof in criminal cases of crimes against property committed with the use of information and telecommunication technologies, associated with disproportionately long periods of obtaining information serving as evidence, which in turn lead to a violation of the principles of criminal justice. As a result of the application of general scientific methods for conducting scientific research, incl. analysis of the current legislation, statistical data, practice of international cooperation and materials of criminal cases, it is proposed to optimize the criminal procedure legislation in the field of evidence in criminal cases of the above category in order to reduce the time for collecting evidence.

International and area studies in vocational training: new trends and challenges

Russian universities offer many international and area studies for Bachelor's or Master's programs for students intending to work in the sphere of international cooperation. There has been, however, limited research into how these programs meet the learning needs of students in international and area studies. The rationale for conducting this research is to provide insights to educators on how they might design courses to develop better professional skills. A review of the literature highlights the concerns of academics and practitioners about the balance in curriculum emphasis between political theory and international cooperation practice. This study examined the merits of different pedagogical approaches through the experiences of educators from different tertiary offerings. It is argued that there are some categories of proficiencies that are required to sustain a career in the field of international and area studies. Based on the findings, recommendations have been provided in arranging curriculum and academic activities. Critical thinking, writing, political analysis, role-play, and public speaking are highly recommended to be incorporated into the area studies curriculum.

Taking into account the results of the study of the practice of international cooperation in the field of criminal proceedings, conducted by the author, the issue of the subjects of the transfer of criminal prosecution (legal proceedings) continues to be considered in the context of determining the procedural status of persons acting on the side of the defense, as well as other. Based on the results of the study, theoretical conclusions are drawn and practical recommendations are offered.

The article systematizes the world practice of international cooperation in the interests of border security under the conditions of development of world processes globalization, which leads to an increase in the number of different levels of tasks and problems that arise in the formation of relations between countries on an international platform. Emphasis is placed on the expediency and features of the international experience of integrated management of state bodies at borders in the framework of international cooperation. The European model of management is analyzed, which has prospects for its implementation in a number of European countries that are not part of the European Union, as well as in the countries of Central Asia. Emphasis is placed on the incorrect terminological use of such phrases as “integrated border management”, “complex border management” or “coordinated border management”, which does not correspond to the semantic essence. A new phrase was introduced – “integrated management of state bodies at borders”. Models of international cooperation are analyzed on the examples of the Eurasian Economic Community member states and the CIS member states, African countries and the Scandinavian countries in the issues of integrated management of state bodies at the borders. Conclusions are made and prospects of further researches are defined.

Theoretical and practical aspects of provisional application of double taxation avoidance agreements are analysed in the article. The author analyses the conditions of provisional application of protocols on amendment of Russia’s tax treaties with Malta and with Cyprus of 2020. The Russian Federation as a rule resort to provisional application of international treaties only in exceptional cases when the treaty is of exceptional interest and there is a need in its “start” before its entering into force. The author draws attention to the fact that the provisional application of the treaty can be regulated both with indication on this condition in the treaty itself or with separate treaty. The author also provides examples from the practice of international cooperation into the tax sphere.

Prospects for Scientific and Innovative Interaction Between China and Kazakhstan Within the Belt and Road Initiative

The dynamic economic growth of China, the expansion of trade, the huge demographic potential, the development of innovations and the introduction of new technologies have attracted the attention of politicians and researchers from around the world. A new level of economic integration between Kazakhstan and China requires enhanced cooperation in not only the political, trade, financial sectors, but also, which is no less important, in the field of education and innovation. This is due to the fact that not only politicians, businessmen, but also ordinary people will join the system of relations in the process of economic integration of the two countries, with their help joint production and joint products will be created. Implementation of the Belt and Road initiative raises new challenges for Kazakhstan and China's cultural and educational spheres. The goal of the research is to examine the prospects of cooperation and innovation in the field of education within the context of the Belt and Road initiative, identify the main areas of educational cooperation and identify key areas of cooperation between Kazakhstan and China. This article contributes to the sense of the Belt and Road initiative to improve the theory and practice of international cooperation between China and Kazakhstan in the field of education and innovation.
 The economic and political interaction between Kazakhstan and China is well studied in world Chinese studies, while cooperation in the field of education still requires research and systematization since this area makes a great contribution to the promotion of China's interests, values and the development of Chinese influence in the region. Thus, this article is intended to fill the gap in this area. This article contributes to the sense of the Belt and Road initiative to improve the theory and practice of international cooperation between China and Kazakhstan in the field of education.

International Cooperation among Tertiary Educational Institutions: Trends and Prospects

Within the conditions of rapid development of internationalization processes, the scale of international cooperation between tertiary educational institutions is growing at a quick rate. Currently, the practice of international cooperation between tertiary educational institutions is the most commonly encountered in the form of: international exchange of apllicants of tertiary education (students), teachers (educators), scientists; holding conferences, round tables, symposiums; exchange of information and data on improving the efficiency of the educational process. Therefore, the list of the above mentioned types of international cooperation between tertiary educational institutions is not exhaustive and is constantly updated. Based on the foregoing, the aim of the scientific article is to study the theoretical and practical aspects of international cooperation among tertiary educational institutions in the framework of determining current trends and future prospects for the development of such relations. Methods of analysis, synthesis, observation, description and comparison have been used to disclosure the theoretical and practical aspects of international cooperation among tertiary educational institutions in the framework of determining current trends and future prospects for the development of such relations. The scientific article has discussed and analyzed the dynamics of the students’ mobility from abroad, enrolled in tertiary education, as well as the level of students’ mobility in areas of the corresponding level of higher education in such countries, as: Germany, the Czech Republic and Sweden. The peculiarities of the functioning of the following international networks and university wide projects and platforms have been determined, namely: ACCESS, CALIE, European University Association, Eutopia, Inspireurope, International Association of Universities, MIRAI, Nordic Association of University Administrators, Nordic Centre India, Nordic Centre Fudan University, Nordic Institute of Asian Studies, SGroup European Universities’ Network, SANORD, Scholars at risk, SASUF, which have been formed as a result of international cooperation among tertiary educational institutions. According to the data of the European University Association, it has been established that tertiary educational institutions of Ukraine also take an active part in the system of international cooperation. For instance, 26 tertiary educational institutions of Ukraine act as Individual Full Members and Individual Associate Members of the European University Association. It has been established that the basic areas of international cooperation among tertiary educational institutions include: the development of international mobility in the framework of the exchange not only of students, but also of educators, researchers, and administrative staff; joint teaching and investigation activities; research cooperation.

Europol’s International Exchanges of Data and Interoperability of AFSJ Databases

Data sharing and interoperability aspects of Europol’s information systems outside the EU are particularly problematic because of the difficulty of ensuring that adequate legal safeguards are complied with in partner third countries and international organizations. At the same time, the way in which the ongoing interoperability initiatives regarding the Area of Freedom, Security and Justice (AFSJ) databases may influence Europol’s international cooperation raises arguably a set of new legal and practical questions that require urgent consideration. This article examines these issues by connecting the Europol-specific legal framework and international practice to the recently adopted AFSJ interoperability regulations as well as to the EU broader data protection framework. It looks more specifically at the balance between data protection/fundamental rights and operational effectiveness throughout Europol’s legal framework and practice of international cooperation and examines the implications of interoperability of AFSJ databases on this. On the one hand, interoperability of AFSJ databases is likely to boost Europol as an information hub through extended personal data collection and data processing possibilities, thereby making the Agency more attractive to international partners. On the other hand, the possibility to transfer such data outside the EU requires strong and effective safeguards from a data protection perspective. The article tentatively concludes that Europol’s current legal and practical framework for international cooperation seems to tilt the balance on the side of operational effectiveness to the detriment of data protection and fundamental rights, and that the new possibilities offered by the interoperability of AFSJ databases will further enhance this trend. Международные аспекты развития института социального партнерства в сфере труда

Along with the ongoing formation of a digital econ-omy, it is now possible to ascertain the implementa-tion of the so-called “fourth” industrial revolution, which is characterized by the development and mass introduction of artificial intelligence, automa-tion, and robotics into production. Under the influ-ence of these processes there is a transformation of the world of work, the emergence of qualitatively new trends in its development. Experts highlight such most important trends as job cuts in traditional sectors of the economy; distribution of new tech-nologies requiring retraining and retraining of employees; rising unemployment, aggravation of employment and pension problems; expansion of informal employment. Such trends reinforce the need for socio-economic modernization in Russia and determine the relevance of the study of interna-tional aspects of the development of the institution of social partnership. The article concludes that a system of trilateral and bilateral interaction between the state, employers and trade unions at the federal, regional, sectoral and organizational levels based on collective bargaining has been created and is func-tioning in Russia. Based on the use of document analysis methods and case studies, a conclusion is drawn on the implementation in Russia of interna-tional cooperation practices as a direction for the development of the institution of social partnership in the world of work. Such practices include programs of cooperation between the ILO and the Government of the Russian Federation, joint pro-jects of the ILO and Lukoil. The article analyzes the experience of implementing similar programs and projects, discusses their main areas and contents.

International Cooperation in the Field of Covert Investigations

The purpose of the study is to classify and disclose the content of forms of international cooperation in the field of covert investigations, as well as to develop ways to improve the legal regulation of such forms and the practice of their application. Methodology. Methodological tools are selected taking into account the purpose, specifics of the object and subject of research. It is based on a general dialectical method of scientific knowledge of real phenomena, as well as their connections with the practical activities of operational units and pre-trial investigation bodies. These methods were comprehensively used in the systematic processing of: statistical materials on the state of crime and the results of the investigative bodies of Ukraine and Interpol; international treaties and national legislation of a number of states; materials for the practical implementation of these agreements; the results of research on combating international crime; provisions of scientific works on the use by law enforcement agencies of different countries of covert methods of obtaining information necessary to combat crime; materials of operative-search cases and criminal proceedings, during the investigation of which measures of international cooperation and measures of secret receipt of information were applied. Scientific novelty. According to the results of the study, proposals were made to increase the effectiveness of the practice of international cooperation in the field of covert investigations (criminal intelligence, operational and investigative activities). Based on the proposed author's approach to the classification of forms of international cooperation in the field of covert investigations, the directions of improving international law and harmonization of national laws of different countries in terms of using covert methods to obtain information necessary to combat international crime. Conclusions. Forms of international cooperation in the field of covert investigations (criminal intelligence, operational and investigative activities) include: 1) exchange between states of information necessary for covert investigations and information obtained in the course of such investigations; 2) exchange on mutually beneficial terms of special equipment, objects and substances necessary for use in the process of covert investigation; 3) involvement of foreign specialists for their participation in covert investigations or in some covert investigative actions; 4) conducting certain covert investigative actions (covert police operations, intelligence activities in a criminal environment) at the request of another country; 5) conducting a set of covert investigative actions (covert police operations, intelligence activities in a criminal environment) at the request of another state (within one case); 6) conducting joint cross-border covert police operations (covert investigative actions) by law enforcement agencies of two or more countries; 7) conducting a covert investigation (criminal intelligence, operational and investigative activities) at the request of law enforcement agencies of another state; 8) simultaneous conduct of a covert investigation in a particular case in the territories of two or more states by their law enforcement agencies in cooperation. These forms differ in their complexity. Simpler ones may be included in the content of more complex ones. International cooporation in criminal procedure to meet the requirement of globalization trend and international intergration.

On the basis of the new approach, especially the approach to rights in international cooperation in criminal procedures, the article mentions the theory and the practice to improve the efficiency of international cooperation in the criminal procedure in the context of globalization, international integration in Vietnam. The contents of the article include: and areas of international cooperation in criminal procedure; The practice of international cooperation in criminal procedure in Vietnam; Requiring to improve of law and raising the effectiveness of international cooperation in criminal procedure in the context of international integration.

Economic, Social and Cultural Human Rights: The Journey towards Peremptory Norms in International Law

ABSTRACTThe past 50 years of national effort and international cooperation have produced a mixed legacy of unequal enjoyment of economic, social and cultural (ESC) rights. Despite a wide framework of national, regional and international ­­norms and mechanisms for observance of ESC rights and obligations, a systemic tendency disconnects ESC rights from economic and financial decisions necessary for their realisation. To be truly effective, the ‘customary core’ of minimum ESC rights obligations should play a priority role in the economic and financial decision-making of states, international institutions and non-state actors. While this core has not now reached the status of peremptory norms, the duty of international cooperation to realize human rights requires transnational coordination that gives priority to core ESC rights obligations in economic, financial and development policies and operations. Action in three areas is needed: first, building a common approach to ‘core’ content in the inter-institutional interpretation and supervision of ESC rights; second, targeting the widespread practice of international cooperation to better coordinate responsibility for extraterritorial effects on core ESC rights; and third, holding international organisations and their members responsible for the effects of their action on national effort and international cooperation for ESC rights.

The International Dimension of the EU Agencies: Framing a Growing Legal-Institutional Phenomenon

International cooperation has become a salient feature of EU agencies triggering important legal questions regarding the scope and limits of the agencies’ international dimension, the nature and effects of their international cooperation instruments, and their legal status within the EU and on the global level. This article examines the international dimension of EU agencies by advancing a legalanalytical blueprint linking EU law to international public law. The principle of institutional balance and the Meroni doctrine are used as EU law parameters for assessing the agencies’ international cooperation mandate, powers and actions, whilst the concepts of ‘international agreement’ and ‘international legal personality’ serve as standards for clarifying the legal nature of EU agencies’ international cooperation instruments and their legal status as global actors. Case studies on the European Aviation Safety Agency, Frontex and Europol ‘test on the ground’ the legal-analytical framework advanced and offer fresh insights into the EU agencies’ international cooperation practice. Whilst the institutional balance in EU external relations does not prohibit entrusting certain international cooperation tasks to EU agencies, the application of the Meroni requirements suggests a limited role for these EU bodies as global actors. Next, the international cooperation instruments concluded by EU agencies can be legally binding agreements which, as a specific category of technical-administrative agreements, could still be accommodated within the EU legal framework. Albeit EU agencies could acquire in theory a derived and functionally limited international legal personality, none of the three agencies examined has such a legal status entailing that their international cooperation actions are in principle attributable to the Union.

The organization of labour immigrants from Czechoslovakia in Frolov district of the Lower-Volga region in the 1920 and 1930s

Based on unpublished archival sources, this article considers the history and development of industrial organizations of labour immigrants from Czechoslovakia on the territory of the Lower Volga region in the 1920 and 1930s. The activities of the “Agricultural commune of Czechoslovak emigres” and the handicraft “Association of Czechoslovak Emigrants” illustrate how Soviet legislation was applied to labour immigration, how party authorities and economic bodies related to the two immigrant units, and how foreign workers adapted to the conditions in the USSR. Despite the many difficulties that labour immigrants had to overcome, their activities on the territory of Stalingrad province constitute a successful example of international workers’ cooperation in the USSR. The authors demonstrate that the production associations of labour immigrants from Czechoslovakia made a significant contribution to the strengthening and development of the economic complex of Frolov district in the Lower Volga region during the period under review. Through the efforts of the Czechoslovak citizens, shoe production and tanning were organized for the first time on industrial level. Later a metal plant emerged on the basis of the “Krasny Vagranschik” artel created by immigrants from Czechoslovakia. The experience of state regulation on labour immigration in the USSR can be successfully used in modern Russia’s practice of international cooperation.

Features of Norwegian model of the integration with the EU: experience for Ukraine

The integration relations between Norway and EU have been studied in the article. The core of the Norwegian model of participation in the European integration process is the integration without co-determination. Norway is simultaneously both outside and inside the EU. The country is not a member of the EU and it does not participate in any decision-making and policy-making process in the EU and it is also excluded from important aspects of the cooperation, such as Economic and Monetary Union and Common external and security policy. But, Norway has adopted nearly three-quarters of the EU legislation, and it has implemented this legislation more effectively than many of the EU Member States. From the EU’s perspective, Norway is the third country with which the EU is most closely integrated. It has been noted that this Norwegian model has become the subject of intense internal political debates in the UK during the national preparations for the national referendum on the future of this country in the Union. The fundamental characteristics of the Norwegian model of integration with the EU has been identified and described. Thus, Norway doesn’t have the unified institutional structure, with the help of which its relationships with the EU are regulated. An important characteristic of Norway’s agreements with the EU is that they do not have their own material. Also, they are indefinite and are characterized by a substantial gap between formality and reality. Other fundamental characteristics of Norway’s integration with the EU are that this process is reactive, asymmetrical, and remarkably pragmatic. Moreover, Norway’s model of integration depoliticizes many important issues. It has been found that the main pillar of EU – Norway relations is EEA agreement. It is the largest and the most important international legal document, which comprises most of the bilateral cooperation and influences the entire model of association. It has been determined that the key negative feature of Norwegian model of relations with the EU is «integration without representation», which means that Norway is not represented in the EU decision-making processes. But these processes actually determine the development of Norwegian legislation and policy. It has been grounded that in terms of international law and practice of international cooperation, the Norwegian model of relations with the EU is exceptional. Now the European Union does not see the perspective for Ukraine to get the EU membership. Consequently, it has been suggested that in such circumstances Norway experience can be very useful for Ukraine, particularly in the context of development of ever closer relations with the EU, and the integration of national economy into the EU internal market.

The practice of international cooperation in the military-technical sphere: the experience of cooperation of Russia and Tajikistan

The article is devoted to the study of the development process of Russian-Tajik militarytechnical cooperation in the period of the creation of the most important public institutions. The rticle analyses the most important stages of the military collaboration between Russia and Tajikista and the experience of the organisation of military aid and the aid to the civilian population in emergencies. For eech stage of the development of the collaboration the author highlights the priority directions of collaboration. Particularly in the article are studied such aspects of Russian-Tajik military cooperation as the work of the group of military observers of CIS, including the border protection and various types of peacekeeping activities, the supply of military technique, training of military specialists. The author comes to the conclusion that on all the stages of the collaboration was the Russian participation in the regulation of the internal conflicts in Tajikistan, the training of military specialists and the participation in creation of the number of arms of Tajikistan, the supplies of weapons and military equipment, as well as assistance in the protection of the border.
