In people's lives as Indonesian citizens, there are 4 pillars of the Pancasila State which are very important in the ideology and development of the country, which consist of Pancasila as the state ideology, the 1945 Constitution, the Republic of Indonesia in the form of the Republic of Indonesia which has the sovereignty of the people, Bhinneka Tunggal Ika as the state motto. , and mutual cooperation as the spirit of cooperation in society, is a strong foundation for the development of the Indonesian nation. In the context of development, the 4 Pillars of the Pancasila State provide clear direction and guidance for the government and society to achieve sustainable and inclusive development goals. By strengthening the values of Pancasila, respecting diversity, and implementing mutual cooperation in various areas of development, Indonesia can achieve sustainable progress and realize prosperity for all its people. challenges and opportunities in implementing the 4 Pillars of the Pancasila State in the context of Indonesian development, as well as providing recommendations to increase the effectiveness of this implementation. By contributing to understanding the importance of the 4 Pillars of the Pancasila State in guiding Indonesia's development towards a better future.

Pretrial Efforts to Realize Legal Provisions that Are Proportional and Do Not Contract the Perspective Pancasila Law

Pretrial aims to monitor coercive measures carried out by investigators or public prosecutors against suspects, so that these actions are actually carried out in accordance with the provisions of the law, and are truly proportional to the provisions of the law and do not constitute acts that are contrary to the law. The purpose of this research is to describe pretrial legal efforts to achieve justice for underprivileged suspects/families. To analyze pretrials in accordance with the Pancasila legal state perspective. The method used is descriptive, with data sources obtained from journals, books and related articles. The result of this research is Article 22 paragraph (1) of Law No. 18 of 2003 concerning Advocates which states that "Advocates are obliged to provide free legal assistance to justice seekers who cannot afford it." These rules require a lawyer to provide equal access to justice for everyone. This is a form of embodiment of the principle of equality before the law adhered to by Indonesia. In fact, the concept of a legal state for Indonesia is based on the Pancasila ideology, the substance of which includes, among other things, the principle of recognition of God's law, natural law and ethical law. The elements of the Pancasila state are the recognition of guarantees of human and citizen rights; There is a division of power; in carrying out its duties, the government must always be based on applicable laws, both written and unwritten; There is a judiciary that exercises its power independently.

The Relationship of Religion and State Law in Indonesia Paradigm Theory Perspective of the Relationship Between Religion and the State

The discourse on the relationship between religion and the state in the context of the implementation of Islamic law in Indonesia is an issue that will never go stale. This article aims to examine the relationship between Islamic law and state law from a paradigm theoretical perspective on the relationship between religion and the state, a study of the thoughts of Indonesian thinker Prof. Arskal Salim. The type of method used is qualitative, data comes from library materials, the main data is the book "Challenging the Secular State; The Islamization of Law in Modern Indonesia” by Prof. Dr. M. Arskal Salim GP, M.Ag. The data is read, analyzed, separated and categorized and then analyzed using descriptive analysis and content analysis. The research results show that Prof. Arskal Salim in his book raises five issues related to the dynamics and discourse of the relationship between religion and the state in the form of the application of Islamic law in state law in Indonesia. The five issues are the dialectic of the concept of sharia and the issue of the nation state, the dialectic of the formalization of Islamic law and the issue of nationalism, the implementation of Islamic law in the Pancasila state constitution, legislation and the formalization of Islamic law in national law, the formalization of Islamic law in Aceh from the beginning of independence to the reform era. Based on the theoretical analysis of the paradigm of relations between religion and the state, namely the integralistic, symbiotic and secularistic paradigms, a fourth new typology was discovered, namely symbiotic-integralistic which is a combination of the symbiotic and integralistic paradigms. This symbiotic paradigm applies throughout Indonesia, and the integralistic paradigm only applies in Nangroe Aceh Darussalam Province.

The rapid development of the current era of globalization is increasingly suppressing the process of cultural acculturation, especially the influence of western culture, which seems to dominate and is always the trend-centre, the habits and lifestyle of western people seem to be a modern mirror in people's lives. This situation continues to erode local culture and wisdom which is the heritage of the Indonesian archipelago. The ability to face challenges that are very basic and will hit national, social and political life, even mental and national life, the final stronghold is national belief based on the State of Pancasila. Pancasila is a bulwark in facing challenges in the current era of globalization which is increasingly developing. Applying Pancasila values to society, Pancasila is an ideology and foundation of the Pancasila state which is the foundation of all decisions made by the Indonesian nation. Which also means that Pancasila also represents the personality of the Indonesian nation itself. The word Pancasila originates from Indian Sanskrit, namely the word panca which means five, while the word sila has a basic meaning. So the term Pancasila according to each meaning of the word is five basic, from which each symbol of Pancasila is created, which is five, and the contents of Pancasila are also 5 according to the meaning of the word Pancasila.

REINTERPRETASI PANCASILA

Constitutional change and democratization in Indonesia have reopened dialectics and dynamics among religious, cultural and philosophical traditions in the country. Contemporary scholars tend to agree that Pancasila and democracy are compatible with Islam. The interpretation of Pancasila have been widely discussed by a number of contemporary Indonesian scholars. They use their own paradigms and methods in their interpretation of Pancasila. Some scholars urge for the formalization of sharia in a Pancasila state, while others develop the ideas of religious moderation in a Pancasila state. The smaller groups of scholars interpret Pancasila in the secularistic paradigm. This paper discusses the interpretation of Pancasila among Muslim intelligentsia and civil society organizations. It seeks the most relevant and coherent paradigm for interpreting Pancasila. Hence, this paper shall examine the three paradigms of the relation/dialectic of religion and state. This paper maps out the thoughts and models of interpretation of Pancasila, that are discussed by Muslim intelligentsia and civil society organizations. The assumption built at the beginning of this paper is that the symbiotic paradigm has relevance, coherence, and correspondence with the values of Pancasila itself. Therefore, this paper shall examine the assumptions mentioned above. This paper is based on a library research, and also a qualitative research. It is, therefore, a basic/philosophical research as well. The sources of research data in this paper are collected from related documents and other related writings.

Mediation of Criminal Cases as an Effort to Settle Criminal Actions Based on Local Wisdom in Indonesia

Penal mediation is carried out to bring together criminal offenders and victims, so this penal mediation is often also known as "Victim Offender Mediation" (VOM). In Indonesia itself, the use of mediation can be seen in Law No. 30 of 1999 concerning Arbitration and Dispute Resolution. Settlement of cases through mediation is in line with the concept of local wisdom that lives in Indonesian society. The noble values contained in the Pancasila state foundation fade with the times and technology; the values contained therein, such as divinity, justice, decency, harmony, unity, humanity, and mutual cooperation, are no longer reflected in the lives of the nation, state, and society. Society is also included in the formulation of legal products. Penal mediation is less well known among Indonesians. In mediation, the urgency is the value of Pancasila in the settlement of criminal cases in Indonesia, which is the community's need for a progressive, humane criminal dispute settlement that provides a sense of justice for victims, society, and perpetrators, which cannot be carried out by national criminal law. The local wisdom of people in various regions of Indonesia in the settlement of criminal disputes based on deliberation and consensus (mediation) as local institutions has not been utilized optimally in answering this problem. The formation of law in Indonesia is based on historical aspects and is in accordance with the conditions and circumstances of the people. In mediation, it requires the involvement of all stakeholders in solving criminal acts through mediation based on local wisdom using impartial or neutral media and mediators.

The Threat No More? Indonesian Atheists, Pancasila, and the Search for A Common Moral Ground

The fall of Soeharto's rule in 1998 marked the beginning of a new era in Indonesian democratization, allowing old and new voices in the public realm, including atheists who defined themselves as no less Indonesian and, more crucially, no less moral than the rest. Globalization and increasing access to information and communication technology facilitated this. This article analyses how and why Indonesian atheists have become more outspoken in recent years about their lack of religious belief and defence of their denial of the existence of any deity or gods in response to their upbringing, education, news about religious radicalism, liberalism, and scientific advancement. These atheists provide context for atheism in Indonesia. They also redefine Indonesia as a non-religious nation-state, despite the country's Muslim population and efforts and aspirations to bring it closer to an Islamic state or culture. In numerous official declarations and textbooks, Indonesia has historically been referred to as neither a theocracy nor a secular state. It is a Pancasila state. Indonesian atheists redefine the country as a whole by reinventing Pancasila and Bhineka Tunggal Ika. They are not opposed to collaboration and unity. Instead of sacred or religious principles, they emphasize humanity and morality as common values.

Criticism of the Implementation of the New Public Management (NPM) in Indonesia Based on the Perspective of Article 33 of the 1945 Constitution

This study aims to criticize the implementation of NPM in Indonesia which is considered unable to answer what is mandated by article 33 of the 1945 Constitution. The implementation of NPM will have a more positive impact on Indonesia, which is a developing country if its implementation is based on Article 33 of the 1945 Constitution. This is a critical study with a literature study approach. The values contained in Article 33 of the 1945 Constitution are related to the concept of NPM. This research shows that the alignment of NPM implementation with article 33 of the 1945 Constitution can increase the role of NPM for public companies in Indonesia which is a Pancasila state.

Integration Between Customary Law and National Law: An Effort to Build a Pancasila Prismatic Law State

Introduction: This article to examine and analyze aspects of integration between national law and customary law in the context of the prismatic Pancasila state law, especially after the enactment of the draft criminal code (RKUHP) as a law. Purpose of The Research: This research seeks to answer two problem formulations, namely: integration of customary law and national law in the Pancasila law state and how are efforts to organize harmonious relations between customary law and national law in the perspective of the prismatic Pancasila state law, especially after the ratification of the RKUHP.Methods of Research: This study uses normative legal research methods based on authoritative legal products in the form of laws and regulations. The analysis was carried out by prioritizing the concept approach, historical approach, and statutory approach. Result of The Research: Even though customary law and national law are different in substance and character, but customary law and national law must be integrated because have important relations in relation to practice in society. Efforts to organize a harmonious relationship between customary law and national law in the perspective of the Pancasila prismatic state law, especially after the ratification of the RKUHP by optimizing the three year transitional provisions in the RKUHP to socialize as well as determining steps and efforts that can guarantee harmonious relations between customary law and national law.

The importance of re-earthing the values of Pancasila in the lives of all levels of society because post-reformation until now has been found to be an indication of the strengthening of radicalism, intolerance and moral degradation in the lives of all levels of Indonesian society. If this condition continues to develop, it is feared that it will encourage disintegration of the nation. Moral degradation and radicalism have not only hit many people but have also entered the world of education. Therefore, it is important to implement the earthing of Pancasila to all levels of society in general and students in particular in all educational units. To socialize and ground the material on the ideology of the Pancasila state to students, students use the lecture and question and answer method which lasts for 120 minutes. With the socialization and grounding of Pancasila for junior high school students, the tourism industry of the USI Foundation, it is hoped that early on, students will be spared from various movements of radicalism, intolerance and moral decadence that are currently developing in the younger generation and students in particular. Perbandingan Konsep Negara Islam : Analisis Pemikiran Syekh Taqiyuddin An-Nabhani dan KH. Abdurahman Wahid

This paper examines two concepts of ideal state thought according to Sheikh Taqiyuddin an-Nabhani and KH. Abdulrahman Wahid. According to KH. Abdurahman Wahid, the Islamic state is the Pancasila state that exists today in the Unitary State of the Republic of Indonesia because in addition to Pancasila containing the concept of monotheism in its first precepts, it is also because Islam is a religion that highly values diversity and plurality. Meanwhile, according to Sheikh Taqiyuddin an-Nabhani what is called an Islamic state is a state with the form of a Khilafah because according to him only with a Khilafah all Islamic teaching can be implemented perfectly. This paper compares, reviews and critiques each of these thoughts so that it is hoped that there will be a new finding from these two contrasting thoughts. The results of the research show that the debate about an Islamic state has not yet reached a single point of agreement. In fact, discussions about the concept of an Islamic state are always interesting to study to serve as a reference source for existing treasures of political thought.

Revolutionizing Pancasila as the ideology of Indonesians

This article examines whether Pancasila as the sole principle and ideology and state philosophy is reflected in the Indonesian society. Understanding and appreciation of the values of Pancasila ideology are often considered only as a jargon, i.e., in the verbal perspective. Its implementation is neglected due to lack of insight and knowledge about Pancasila and not knowing its basic principles. Pancasila, which consists of five precepts, includes a series of attitudes and knowledge as well as hopes from the struggle of the Indonesian people to gain independence, and is regulated in the Pancasila state. The first precept is about God the Almighty ( Ketuhanan yang Maha Esa ); the second precept is about just and civilized humanity ( Kemanusiaan yang adil dan beradab ); the third precept claims the ‘unity of Indonesia’ ( Persatuan Indonesia ); the fourth precept claims democracy led by wisdom in the representative deliberation; the fifth precept claims social justice for all Indonesian people ( Keadilan sosial bagi seluruh rakyat Indonesia ). Pancasila is the source of all laws in the Constitution of the Republic of Indonesia, which constitutes it as a sovereign and prosperous country supporting the wealth of its people, the divinity in the One and Only, freedom of religion, respect for diversity and pluralism, and building a democratic state. Social problems that often occur in every society usually start from breaking the law, dangers of the extremism doctrine, and criminal acts of corruption that can damage the grassroots of Pancasila. Therefore, to defend the country and strengthen the basic precepts of Pancasila, it is necessary to understand and deepen the practice of Pancasila in the ideology of nationalism and democracy.

Implementation of State Theory of Law in The Country Based on Pancasila

This article discusses the concept of the rule of law in the Pancasila State. In the rule of law theory, law has a very high position. It is above all. Indonesia as a state of law, as stipulated in the 1945 Constitution of the Republic of Indonesia Article 1 paragraph (3), has an obligation to carry out its state functions so that it is always based on applicable legal norms. Merdeka Belajar in the perspective of the Law No. 20 of 2003 on the National Education System, has an important role in the development of the character of the pupils. As the concept of independent university learning with a concept of hybrid education for the first three semesters in the major is in demand as part of character formation in the field. Like working on a village project, social welfare, entrepreneurship, internships in companies and so on. The national educational system within the boundaries of character education is expected to produce qualified people, in building the cultural character of the nation, the educational environment should lead to the creation of a conducive environment in accordance with the Pancasila State and UUD 1945. This research is a study with a normative jurisprudential approach. The results of this study show that character is a good objectivity over human qualities. THE THOUGHT OF FIGURES OF ISLAMIC MASS ORGANIZATION ABOUT CALIPHATE: A CASE STUDY IN BANDA ACEH AND WEST JAVA

This article aims to address the questions related to the support and rejection of figures of Islamic mass organizations to the concept of the caliphate. Some of the previous literature limited the object to the behavior of the Muslim community towards the ideology of the caliphate in the historical context and its relation to the modern state, neglecting the source of inspiration for the caliphate ideology as understood and perceived by figures of mass organization Indonesia. Therefore, using a phenomenological approach, the researchers attempt to fill the gap in this particular issue. This research was conducted in two cities in Indonesia, Aceh and West Java. This form of field study takes a phenomenological approach and thus is exploratory. Interviews and documentation have been used to collect data. This research found three main tendencies of Islamic mass organizations in Aceh and West Java in understanding the concept of the caliphate, textualist-substantive, contextualist-substantive, and ideological-political. Textualist-functionalists see the Islamic caliphate as mandatory, without having to change the ideology or identity of a country. Contextualist-Substantive argues that the Khilafah is a value that does not contradict with Pancasila's state ideology. Ideological and political Islamists believe that the fight to establish an Islamic State, or Daulah Islamiyyah Khilafah, is a necessity and even an obligation.

The research problem formulation is the legal politics of the DKI Jakarta government's policy in implementing Formula-E during the covid-19 pandemic. The purpose of this research is to determine the interests of the people affected by the implementation of Formula-E, which is used as a regional priority scale in the implementation of Formula-E Instruction Governor (INGUB) Number 49 of 2021. This type of research is descriptive qualitative; namely, it describes research based on theories and legal materials about legal politics and policies made by the government. This study uses a qualitative descriptive method using literacy studies and legislation—techniques in analyzing data using narrative analysis techniques. This study concludes that the administration of government affairs must prioritize the safety of the people first above other interests. The regulations that apply must be under the hierarchy so that the existing regulations do not conflict with higher regulations because the regulations at the lower level must adapt to the regulations at the upper level, namely the 1945 Constitution (UUD 1945) and the Pancasila State Constitution.
