URGENSI PERJANJIAN PRANIKAH SEBAGAI KESEPAKATAN AWAL SUATU PERKAWINAN DAN AKIBAT HUKUM BAGI AHLI WARIS

Abstract A marriage agreement (prenup) is a form of agreement made between one party and another party before holding a wedding ceremony to validate the two as husband and wife. Household issues related to property are closely related to marriage agreements (pre-nuptials). The existence of a marriage agreement (pre-nup) is intended to avoid wealth inequality in household relationships. The aim of this research is to study, analyze and provide a general view to the public regarding marriage (pre-nup) agreements. The research method used is qualitative research through a case study approach using legislation as regulations and also processing data through cases that have occurred as research references. The function and benefits of marriage agreements (pre-nuptials) as a guideline that regulates the rights and obligations of husband and wife regarding the future of the family, whether regarding children's education, business, etc. residence, etc. as long as it does not conflict with law and morality. Protect family members from the threat of domestic violence.

FAKTOR PENYEBAB TERJADINYA PERSELISIHAN DAN PERTENGKARAN TERUS MENERUS DI PENGADILAN AGAMA TILAMUTA

This research is motivated by the difficulty of maintaining and creating a harmonious household. Differences of opinion, lack of communication and various kinds of problems that trigger disputes and disputes between the two. The aims of this research are (1) to determine the factors that cause continuous disputes and quarrels and (2) to determine the consequences of continuous disputes and quarrels. This research was carried out at the Tilamuta Religious Court using a qualitative approach with an empirical research type. The results of the research show that the causes of disputes and quarrels are; a) Economic problems, household needs are not met while there are children and wife's needs that must be met. b) Third party interference, can come from families who are excessively involved in household relationships or from other people. c) Polygamy is unhealthy, the husband is unable to act fairly and is unable to take responsibility for his two wives. d) Domestic violence/abuse occurs, lack of control of each other's egos and coupled with the husband not being able to control his emotions so he takes it out on his wife. The consequences arising from continuous disputes and quarrels include: (a) Disruption in fulfilling the rights and obligations of husband and wife, (b) Problems regarding child custody, (c) Division of joint Assets

Becoming a Victim of Domestic Abuse and Partner’s Lack of Knowledge of Marriage Laws

Domestic abuse with husbands as the offenders and wives as the victims shows that there is an imbalance of rights and obligations in living a married life, despite the rights and obligations of husband and wife are strictly regulated in Law Number 1 of 1974 concerning Marriage. As the offender of domestic abuse, a husband cannot escape from criminal sanctions that have been determined in Law Number 23 of 2004 concerning the Elimination of Domestic abuse. In response to domestic abuse, the author argued, using feminist research and a qualitative methodology, that women (wives) who killed their partners were also victims. Therefore, they shouldn't be imprisoned. This article discusses the public perspective of women who have homicidal as a response to domestic abuse by looking at the motivations behind their actions, rehabilitation tactics, forgiveness policies and protection programs for these women. After careful consideration, the author concludes that the Indonesian government should enact legislation to regulate alternative intervention programs for victims of domestic abuse who have killed their abusers.

FLEKSIBILITAS HAK DAN KEWAJIBAN SUAMI ISTRI PERSPEKTIF MUBADALAH

One of the consequences of marriage is the existence of rights and obligations for husband and wife. So far, these rights and obligations have been understood statically, the husband is obliged to earn a living while the wife's obligation is to serve her husband, look after the house and all other domestic duties. Is that true? Couldn't it be if the rights and obligations of husband and wife were understood dynamically? These questions then led researchers to conduct research with the title Flexibility of the Rights and Obligations of Husbands and Wives from Mubadalah perspective. By using a qualitative research approach, this type of literature study, this research concludes that rights and obligations in the household are a dynamic matter, where husband and wife can work together to earn a living, manage finances together and help each other carry out domestic work. Adapted to situations and conditions and based on the concept of mu'asyarah bi al-ma'ruf.

Marriage is a sacred bond between husband and wife. Getting married makes a person’s life more focused, peaceful, calm and happy. The aim of this research is to describe premarital guidance services in minimizing the divorce rate in KUA Kec. District roof tiles Banyuwangi. This research uses a qualitative research method with a case study type of research. The results of the premarital guidance research carried out included two services, the first was a regular, premarital guidance service, the second was an independent guidance service where there were only mentors and prospective husband and wife couples, it was carried out at moment rafa’. The material presented by the counselors in the implementation of premarital guidance is about the meaning of marriage, how to achieve a sakinah, mawaddah, warahmah family, communication patterns, the rights and obligations of husband and wife.

Domestic violence is a global problem, including in Indonesia, with a high This research started from a case of domestic violence which experienced disharmony in carrying out its rights and obligations resulting in a wife's possessive attitude towards her husband. The formulation of the problem in the research is 1. What is Qira>'ah Muba>dalah's perspective on forms of possessive attitudes of wives in interpersonal relationships between husband and wife in Kauman District, Ponorogo Regency? and 2. What is Qira'ah Muba>dalah's perspective on the rights and obligations of husband and wife in cases of possessive wives in Kauman District, Ponorogo Regency? This research is a type of qualitative field research. The analysis used in this research is descriptive analysis. The findings of this research show that the pattern of husband and wife relations in Kauman District, Ponorogo Regency, there is an imbalance in carrying out rights and obligations. The wife's possessive attitude creates discomfort and conflict, doubts the integrity of the family, and is contrary to the principle of Qira>'ah Muba>dalah. Marriage should be based on cooperation, mutual understanding, and balance in affection. A wife's possessive attitude which limits her husband in carrying out his obligations to earn a living can of course narrow the husband's career space and reduce his knowledge. This excessive control is not in line with Mubjadi's values ​​which emphasize mutuality, partnership and cooperation. Gender equality is important to maintain family harmony.

Bimbingan Perkawinan Ditinjau Dari Teori Sadd Adzariah

This study examines the role of marriage guidance in preventing household conflict in the KUA of Padangsidimpuan Utara District in terms of the sadd adzariah theory. The type of research used in this study was field research (Field Research), using a qualitative approach, primary data sources, namely KUA employees in Padang Sidempuan Utara District, bridal couples who conducted marriage guidance at KUA in Padangsidimpuan Utara District, a total of 2 people, the Koran and the fiqh proposal book written by Amir Syarifuddin while the secondary data in this study are books related to sadd adzariah, journals, regulations of the director general of bimas and various other sources. Data collection techniques in this study consisted of interviews, observation and documentation. The data analysis technique in this research is descriptive qualitative. The conclusion of this research is that the implementation of marriage guidance is carried out at the KUA, Padang Sidempuan Utara District, prospective brides who have fulfilled the documents requested by the KUA and have registered to get married will be summoned by the KUA to carry out marriage guidance, the guidance process is carried out routinely every Wednesday and Thursday at 09.00-11.00 guidance is carried out using the lecture method. The material given is about marriage according to Islam, marriage laws, rights and obligations of husband and wife and dealing with problems in the household. Furthermore, marriage counseling held at the KUA of Padangsidimpuan Utara District is one of the efforts to prevent household conflicts after marriage later through material delivered during guidance as well as Sadd Adzariah's theory, namely efforts to inhibit all roads that lead to damage or prevention.

PSYCHOLOGICAL SKILL ASSISTANCE FOR MARRIED COUPLES WHO ARE ALUMNI OF PRE-MARITAL COURSES AT BP4 - PARIAMAN CITY

This paper aims to see how far BP4 Pariaman City has a role in strengthening human psycho-social in the field of social welfare; services for alumni of post-marriage couples need to be followed up with a balanced program. The lack of psycho-social understanding of pre-marital post-marriage course graduates will have great potential to add to the long line of early marriage ages in Pariaman City. The fundamental problem that is most troubling is their ignorance of the responsibilities, rights and obligations of husband and wife in the household. To overcome this solution, the service team identified the problem of spaciousness. It mapped the problem to be treated (treatment) for the subject of service through two stages: family psychology guidance and Islamic family counseling. The first stage is pre-activity in the form of a Focus Discussion Group (FGD) presenting lecturers as participants to provide input for the mentoring action plan to be carried out. The second stage is action activities, including psychological skill assistance in family psychology and group counseling. This activity has generally received appreciation from stakeholders (BP4 Pariaman City management, pre-marital course alumni) because this program has offered various alternatives for their self-development in elaborating their knowledge to be applied in household life. The results of the reflection and evaluation of the program offered by the service conclude that they understand that a sakinah mawaddah wa rahmah household life is not achieved by material wealth but by the ability to accept oneself and have a correct understanding of an Islamic household. They understand that household problems cannot be measured only by logic. However, it includes religious and spiritual matters the human mind cannot reach. Therefore, they understand that household responsibilities are worldly matters and matters of the afterlife, which are related to God.

PERLINDUNGAN HUKUM TERHADAP HAK-HAK ISTRI KORBAN KDRT PASCA PERCERAIAN BERBASIS NILAI KEADILAN DALAM HUKUM ISLAM DAN HUKUM NASIONAL

This article examines the issue of forms of legal protection for the rights of wives of domestic violence victims based on the values of justice. This is because victims of domestic violence are increasing from year to year, even though there is a Law on the Elimination of Domestic Violence, this phenomenon still continues. Therefore, this issue is important to study in order to get a clear picture of the forms of legal protection that can be obtained by victims of domestic violence. The research approach is a qualitative approach with a normative juridical scientific approach, the data is in the form of secondary data sourced from statutory regulations and studies of Islamic jurisprudence literature. In the discussion it was revealed that: Firstly, the forms of legal protection in legislation are classified into: 1). Preventive action, namely a form of legal protection by clearly regulating the rights and obligations of husband and wife, this has been regulated in the Marriage Law and KHI. 1). Repressive action, namely a form of legal protection when domestic violence has occurred, then this falls into the category of criminal law where the perpetrator is threatened with a crime, this has been regulated in the 2004 Domestic Violence Law. Secondly, in Islam legal protection is more comprehensive, by regulating the laws between husband and wife, both laws relating to civil matters during and after divorce. Likewise, Islam clearly provides legal protection for victims of domestic violence, by enforcing hudud penalties for perpetrators of domestic violence.

Tradisi Perhitungan Weton Dan Pengaruhnya Terhadap Keharmonisan Rumah Tangga Di Desa Sidomulyo Dalam Perspektif 'Urf

The Qur'an and hadith do not specifically discuss the weton calculation tradition, but the people in Sidomulyo Village, Jakenan District still maintain this belief as an integral part of Javanese cultural heritage. Ideally, household harmony is measured by fulfilling the rights and obligations of husband and wife, but the majority of people in Sidomulyo Village, Jakenan District still believe in weton calculations, and this is the benchmark for household harmony. The aim of this research is to determine the tradition of calculating weton in Sidomulyo village, Jakenan subdistrict and its impact on household harmony according to 'urf rules. This study used qualitative research methods. To gain an in-depth understanding of the Weton calculation tradition, researchers conducted interviews with research subjects. This research was located in Sidomulyo Village, Jakenan District. The interview technique was conducted in depth with eight married couples using weton calculations. The results of this research show that the people of Sidomulyo Village believe in the importance of calculating the weton before getting married. They believe that calculating weton is one of the steps to seek safety and achieve harmony in the household and calculating weton for marriage, as happened in Sidomulyo Village, is considered an acceptable 'urf.

Legal awareness in disabled families shows a fifty-fifty point, where someone with a disability has the courage to try to get married and fulfill their rights and obligations as a husband, especially the right to support their family. Although not all blind families know and understand the details of marriage law such as marriage conditions, rights and obligations of husband and wife, child gifts, as contained in applicable family law principles. Efforts to work coupled with skills and job opportunities have grown significantly, in Indonesia in 2022, there will be 720,748 disabled workers, an increase from 277,018 people in 2021. On the other hand, awareness of disability law in the public sphere is still lacking, where it is still limited. access to facilities and infrastructure at Special Schools and Community Learning Activity Centers at the village level which motivates increasing insight and skills with disabilities as an improvement in living standards, whereas in the realm of legal apparatus, judiciary and correctional institutions, there is minimal implementation of the fulfillment of disability rights, such as supporting facilities for sign language interpreters and the use of Braille, disabled-friendly building facilities and legal information outreach to people with disabilities.

Islam has complete rules regarding marriage and family. Basically, suscatin is an effort made in the formation of a household so that the bride-to-be is able to apply psychological provisions and skills in dealing with household problems. In this research, one of the theories, namely Shertzer and Stone, guidance is a process of assistance shown to individuals to recognize themselves and their world. This is an implementation of the Decree of the Minister of Religion Number 517 of 2001, concerning the Organizational Arrangement of KUA District/District. (KUA) Sorong Kota District before the implementation of the marriage contract for the two brides must provide premarital guidance so that the bride and groom understand the purpose and purpose of the marriage. So that later or after becoming husband and wife, they know the rights and obligations of husband and wife.

Reducing the Divorce Rate in the Religious Courts Through Cultivating Egalitarian Relationships

The income factor is often the reason for divorce by petition, a phenomenon of high divorce rates in Indonesia. Furthermore, this problem has resulted in various analytical results. It is very embarrassing that all these analyses tend to blame one party, namely that often, the wife is blamed without presenting writings about wise efforts to resolve relationship problems that lead to mutualism. Apart from that, previous researchers were still trapped in understanding the husband-and-wife relationship as a relationship that was nothing more than a matter of the rights and obligations of husband and wife, which were considered absolute. Even though the perspective of interdependence as something prescribed in Islam has begun to be discussed, there has yet to be a study or offer on how to improve the pattern of interdependence in the lives of husbands and wives. This research aims to provide a practical way to create an egalitarian relationship between husband and wife by first uncovering the causes of the difficulty of implementing an egalitarian pattern in husband-and-wife relationships, which is a factor in the increase in divorce cases due to income reasons. This research uses an empirical or psychological phenomenological approach based on Gary Chapman's "Five Main Love Languages" theory. In selecting subjects, researchers used purposive sampling. Researchers conducted interviews with four ex-husband and wife couples in cases of divorce for reasons of livelihood in the jurisdiction of the Kediri City Religious Court. The result is a vacuum of emotional affection between husband and wife, which causes the wife to resist and be unable to give up her desire to fulfill household needs, a form of contextual and egalitarian role division. Instead of creating an egalitarian husband and wife relationship, the relationship ended in divorce. Thus, a sufficient husband and wife's love tank is the primary condition for carrying out their roles contextually and egalitarian.

Kepastian Hukum dalam Proses Perceraian Talak di Hadapan dan Melalui Izin Mahkamah Negara Bagian dan Wilayah Persekutuan Malaysia

Divorce that occurs outside and without permission from the court raises many legal problems, from the validity of the divorce to the non-fulfillment of the rights and obligations of husband and wife after divorce. Malaysia is a country consisting of states and an alliance area which in its Islamic family law rules regulates divorce before the court to ensure legal certainty. This paper discusses the procedures for the divorce of Malaysian citizens that must be carried out before the Malaysian Court and the rules for registering talak for divorces that have already occurred not in front of and without the permission of the Malaysian Court. The regulations for imposing divorce outside the Malaysian Court also include penalties (punishment) for violators. This paper uses a juridical-philosophical approach to explain the procedure for divorce before the court and the rules related to the registration of divorce that have been carried out outside and without the truth of the court to create legal certainty. This research is a qualitative type of literature research. The conclusion of this paper shows that the rules related to divorce before the Malaysian Court indicate legal certainty because in the process the judge examines the validity of the lafadz talak that the husband has imposed to ensure the validity of the legal status of divorce in Sharia and the state administratively, as well as the fulfillment of the rights and obligations of husband and wife after divorce.

Putusan dan Penetapan PA Kuningan Nomor 492/Pdt.G/2022/PA.Kng tentang Gugurnya Ikrar Talak Suami dalam Cerai Talak

The case of the cancellation of a husband's divorce vow in a divorce talak is not a new thing, in fact this case has often happened in almost all regions in Indonesia. This happened because on the day of the hearing for the divorce pledge the applicant was not present, so that the applicant's or husband's application for the divorce pledge was invalid and did not have permanent legal force. The purpose of this research is to find out whether the judge's considerations used in deciding case Number 492/Pdt.G/2022/PA.Kng are in accordance with Islamic law and positive law or not, then analyzed using a comparative study. The research method used by the author is qualitative research by combining two types of data, namely data obtained from field research in the form of structured interviews and documentation at the Kuningan Religious Court, combined with library research data in the form of documents of decisions and determinations of judges regarding the divorce talak case. The data that the author obtained was then reduced, presented and concluded using descriptive-comparative analysis techniques. Based on the research carried out, conclusions were obtained including: 1) The basis that is the legal source used by the Judge in the process of deciding on divorce talak at the Kuningan Religious Court, namely using the Law, Het Herziene Indonesisch Reglement (HIR), and Reglement voor de Buitengewesten (RBg), as well as non-juridical considerations (Islamic Law) Judges use the Compilation of Islamic Law and Judges also include verses from the Koran. 2) The judge's consideration regarding the husband's right to give talak was in accordance with Islamic law and positive law. 3) In the comparative analysis aspect regarding the divorce vow before a judge is in accordance with positive law, but not in accordance with Islamic law. 4) The cancellation of the husband's talak status in case Number 492/Pdt.G/2022/PA.Kng was due to the husband's absence on the day of the trial for witnessing the talak vow which was in accordance with positive law but not in accordance with Islamic law, due to the consequences experienced by the husband who imposing divorce on the wife in the form of the husband's obligation to provide support for his wife and children, so that in this case it has harmed both parties for the future.

Islamic Counseling on Psychological Aspects of the Sirri Marriage Case: Five Women's Voices in the Narrative Investigation

Unregistered marriages have become a phenomenon in several countries and have an impact on wives and children because marriages are not registered with the government. This research aims to report the psychological impact on wives and children in Indonesia. Five female participants in unregistered marriages were involved in narrative inquiry research. Data collection was carried out through semi-structured interviews. Interviews were also conducted with ustadz and amil (community figures). The data were analyzed using narrative analysis. The results showed that the wives experienced mental disorders (neuroses), which were influenced by frustration (pressure), conflict (inner conflict) and anxiety due to several things, including the lack of legal certainty and treatment of the husband. Apart from that, the factors causing unregistered marriages are women's ignorance of the concept of marriage, which includes the rights and obligations of husband and wife, and economic aspects. This research has implications for the legality of children resulting from unregistered marriages related to inheritance and administration rights.

Analysis of the Rights and Obligations of Husband and Wife in the Compilation of Islamic Law: A Review from the Perspective of Gender Equality

Purpose – This research aims to identify the manifestation of gender injustice in the Compilation of Islamic Law, especially in the chapter on the rights and obligations of husband and wife.
 Methods – The research method used is library research with qualitative analysis.
 Findings – The analysis shows that Article 79 Paragraph 1 creates stereotypical gender roles by reinforcing the traditional roles of husband and wife. On the other hand, Article 79 Clause 2, and Clause 3 reflect the principles of gender equality and justice in legal rights. The husband's duties, as set out in Article 80, involve a guiding role and financial responsibility, with the issue of discrimination in women's education in Article 80 Clause 3. The wife's duties, as outlined in Article 83, create the potential for gender injustice through psychological pressure, with Article 83 Paragraph 2 indicating a double burden in managing household affairs. Finally, Article 84 Paragraph 1 highlights the potential for gender injustice in judging the wife as nusyuz (defiant), creating inequality in response to acts of defiance from both parties.
 Research implications – In the Compilation of Islamic Law, marriage aims to achieve a household life that is sakinah, mawaddah, and rahmah (peaceful, loving, and affectionate). To achieve this goal, married couples must commit to fulfilling their rights and obligations according to their respective abilities.
 Originality/value – This research is important to identify and explain the differences in status between husbands and wives, opening up space for reflection and a better understanding of aspects of gender equality in the context of Islamic marriage.

Tinjaun Pernikahan Dalam Masa Iddah Istri Terhadap Surat Edaran Dirjen Bimas Islam

This article examines the review of marriage after a circular issued by the Ministry of Religion regarding marriage during the wife's iddah period. In the circular there is a provision that the husband can remarry another woman if the wife's iddah period is over. If this is related to the provisions on the wife's iddah period, both in Islamic law and positive law, there are no rules that explain the husband's obligation to wait for the wife's iddah period when he wants to carry out a marriage with another woman. So the issuance of this circular letter will certainly have a positive impact and benefits for women who are undergoing the iddah period and will have time to improve their households. However, on the other hand, if these rules are not implemented properly, it is feared that hidden polygamy will occur by the husband. In this case, to dig deeper into this research, the author used a qualitative descriptive method so that the author conducted research directly in the field with several related sources.

Legal Certainty of the Rights of Wives and Children After Divorce

The position of suspicious children in the perspective of Islamic law is a topic of significant interest and importance within legal and ethical discourse. In Islamic jurisprudence, the treatment and rights afforded to children, particularly those born under suspicious circumstances, hold profound implications for both societal norms and legal frameworks. Understanding the nuanced stance of Islamic law towards suspicious children necessitates a comprehensive exploration of religious texts, legal principles, and contemporary interpretations. This research aims to see what the rights of women and children are after divorce, what is the legal certainty in fulfilling the rights of women and children after divorce in the Religious Courts, and what are the obstacles to fulfilling the rights of women and children after divorce in the Religious Courts. This research method uses a qualitative method with content analysis approach. From the research that has been carried out, it was found that legal certainty in fulfilling the rights of women and children in the religious court environment is still not effective. The issue of the rights and obligations of husband and wife in the event of divorce is closely related to the legal awareness of both parties. So there is a need for good legal awareness among the public regarding the rights and obligations of marriage. Good legal awareness has a causal relationship with the effectiveness of legal certainty of the rights of children and wives after divorce.

Representation of Family Law in the Digital Space: A Study of Discourse Analysis on Instagram Accounts

The emergence of interesting content through Instagram accounts managed by a person or a certain group representing a family law is important to discuss. One of the discourses that appears in these contents is related to the advice of husband and wife in building their household, then brings up tips for husband and wife to pay attention to each other. The husband and wife can apply the contents which are posted on the instagram account to create a harmonious household life. This paper aims to see the narratives that appear in the posts of intagram accounts through a discourse analysis approach. This research data is focused on 3 Instagram accounts with a selection of many followers on the Instagram account. The 3 Instagram accounts are @suami.istri.bahagia, @nasihatsuamiistri, @suamiistriromantis. This research leads to Netnographic studies or digital-based research. Then, because the data obtained is in the form of written content narratives, pamphlets, and videos posted on Instagram, it will be analyzed using discourse theory. The results showed that the content of the program gave rise to two studies that represented family law. First, it relates to the husband's obligation to the wife and the wife's obligation to the husband by posting content in the form of advice for the husband and wife. Second, post content about parents' obligations to children by posting narratives in the form of tips and procedures. Furthermore, the author found that the problem that occurs in these Instagram accounts is the existence of gender bias, this means that posts that represent family law are more content intended for the Wife and their content reflects the business of selling Products.
